Placement of Material in File. Within five (5) work days, any material placed in the employee's personnel file shall be provided to the employee. Should any materials derogatory to an employee's conduct, service, character, or personality be placed in his/her personnel file, the employee shall acknowledge that he/she has read such material by affixing his/her signature to the actual copy to be filed, with the understanding that such signature merely signifies that he/she has been shown the material and does not necessarily indicate agreement with its contents. No material which may be used for punitive action may be placed in the personnel file if sixty (60) calendar days have elapsed from receipt of the written complaint. For any materials derogatory to an employee’s conduct, service, character, or personality, the employee may submit a rebuttal within thirty (30) days which shall be placed in the employee’s personnel file. An employee may submit a second rebuttal to the material after two (2) years.
