Paid Time Off, Personal, and Medical Leaves of Absence. The Medical Center’s Policies regarding paid time off, personal, and leaves of absence for medical or other reasons shall comply with applicable laws, including but not be limited to the Family Medical Leave Act. Without limiting the foregoing, the Physician-in-Training shall be entitled to a total of twenty (20) paid days of paid time off (which include all holidays and vacation), plus up to forty (40) hours per year of sick pay for use as needed for incidental illness (of self or a family member) or reasons related to being a victim of domestic violence, sexual assault or stalking during the term of this Agreement, which shall be prorated based upon the time spent “in-training” during the term of this Agreement. Such paid time off may be taken only at those times, which will not be disruptive to the training schedule of the Program. Such paid time off shall be scheduled and approved by and coordinated with the Director. The stipend described above shall not be paid in the event of any leave of absence (other than an approved paid time off) in excess of one (1) week, except as may be specifically described in the Policies attached to this Agreement or as otherwise provided by applicable law. The Physician-in-Training expressly acknowledges that additional training after a leave of absence and/or multiple incidental absences may be needed for successful completion of Program Requirements and/or for Board certification requirements and that the Medical Center may not be obligated to provide such training beyond the expiration of the term of this Agreement as set forth above. The amount of sick leave, leave of absence, incidental absence, or disability time that will necessitate prolongation of the training time for the Physician-in-Training shall be determined by the Program Director and the requirements of the pertinent RRC and/or certifying Board. Such determination shall not be subject to the Fair Hearing procedures described at Article IX, below. Paid Time Off, Personal, and Medical Leaves of Absence. During the Appointment Period, Trainee shall be eligible to participate in City of Hope-approved time off (e.g., vacation, sick and personal days) in accordance with City of Hope’s GME policies and procedures, including, but not limited to, the ACGME Trainee Leave policy. Trainees are entitled to a total of 25 days of paid time off (which includes 20 vacation days and 5 incidental sick days) during the term of this Agreement, which shall be pro-rated based upon the time spent “in-training” during the term of this Agreement. Such paid time off may be taken only at those times that will not be disruptive to the training schedule of the Program. Such paid time off shall be scheduled and approved by and coordinated with the Program Director. Trainees are eligible for a paid leave for a qualifying reason that is consistent with applicable laws. Information regarding qualifying events as well as time allotment can be found in the ACGME Trainee Leave policy.

Such determination shall not be reviewable under the due process guidelines set forth in City of Hope’s Trainee Grievance and Due Process Policy Fair Hearing procedures described below. In addition to the paid time off and leave addressed in this section, Trainee may be entitled to additional time off or leave as provided for under applicable laws and City of Hope’s policies.

Related to Paid Time Off, Personal, and Medical Leaves of Absence

  • Medical Leaves of Absence When recommended by an employee's personal physician in writing, a medical leave of absence for a three (3) month period will be granted by the Sheriff. Such leave may be extended for a like three (3) month period or shorter period, within the sole discretion of the Sheriff, up to a maximum of one (1) year. Such extension, if granted, shall be based upon the written certification by the employee's physician that the continued illness or disability precludes the employee from working and the continuation of the leave of absence is necessary. Such leave, up to a maximum of three (3) months, if granted, will be allowed and credited as continuous county service, i.e. seniority continues for the three (3) months only. The employee shall be entitled to his former position or a position for which he is able and capable of performing upon return to work. A medical leave of absence shall be without pay and other fringe benefits, except an employee may use his accumulated sick leave time and accumulated vacation time to avoid loss of wages during such leave.

  • Personal Leaves of Absence SRD includes the time an employee is on "leave", if the employee is on a: • personal leave of absence with pay; or • personal leave of absence without pay which is less than 15 working days; or • personal leave of absence without pay which is more than 15 working days and which was started on or after April 15, 1993 -- only that portion which was taken during the period from April 15, 1993 to August 31, 1997. • prepaid leave of absence, under the enhanced leaves of absence policy dated April 16, 1993, greater than eight (8) weeks.

  • Medical Leave of Absence Where you have a medical leave of absence due to any medically determinable physical or mental impairment that can be expected to result in death or can be expected to last for a continuous period of not less than six months, and you have not returned to employment with the Company or an Affiliate, a Separation from Service has occurred on the earlier of: (A) the first day on which you would not be considered “disabled” under any disability policy of the Company or Affiliate under which you are then receiving a benefit; or (B) the first day on which your medical leave of absence period exceeds 29 months.

  • Personal Leave of Absence The Administrator may grant a request for leave of absence for personal reasons without pay provided that he receives at least one (1) month's clear notice, in writing, unless impossible, and provided that such leave may be arranged without undue inconvenience to the normal operations of the Nursing Home. Employees when applying for such leave shall indicate the proposed date of departure and return. Such leave shall not be unreasonably withheld.

  • Unpaid Personal Leave of Absence 1. Any employee may apply for an unpaid personal leave of absence for good and sufficient reason. Leave pursuant to this provision may be for a period not exceeding twelve (12) months in any fourteen (14) consecutive months. Such leave may be granted at the discretion of the appointing authority and shall not be unreasonably denied. Employees are encouraged to consult with their agency/department Personnel Officer to determine if they are eligible for benefits available under the Federal Family and Medical Leave Act. All requests for such leave and responses shall be in writing. The application for leave must specifically state the reasons for such application and the length of time requested. After completion of a period of personal leave of absence, the employee shall be entitled to return to the organizational unit, status and position held immediately prior to the beginning of the leave of absence. If the employee's position is abolished during any such leave, he/she shall be notified and allowed to exercise his/her rights under the Seniority Article of this Agreement.

  • Educational Leave of Absence Leaves of absence may be granted up to six (6) months under the above provisions only if the course would be beneficial to both the University and the employee.

  • Maternity/Child Care Leave A. The Board agrees to provide employees with a child care leave of absence, without pay, as set forth below:

Upon written request from the employee and upon approval of the College President, unpaid leave of absence may be granted to any employee for such things as: (a) illness; (b) family emergency; (c) maternity/paternity; (d) adoption; (e) education; and (f) military leave.   • Sick Leave/Personal Leave 1. Each member of the bargaining unit who is regular full-time, in an active pay status, is eligible for ten (10) days of sick leave and three (3) days of personal leave annually. No member of the bargaining unit shall lose the accumulated allowance of unused days of sick leave/personal leave by reason of having been absent for a period without pay, nor shall the employee accumulate any additional days of allowance during the absence. Faculty members needing to use sick/personal days shall fill out the requisite forms according to official College procedures.
