NOTIFICATION OF STATE. RAC shall notify the State of any community meetings, media involvement, or media coverage related to the loading, hauling, or disposal of materials, construction debris, soil, and other wastes under this Agreement in which RAC is asked to participate.

Should a potential archaeological or historical resource be discovered during construction, the Funding Recipient agrees that all work in the area of the find will cease until a qualified archaeologist has evaluated the situation and made recommendations regarding preservation of the resource, and the State has determined what actions should be taken to protect and preserve the resource. The Funding Recipient agrees to implement appropriate actions as directed by the State. The initiation of any litigation or the threat of litigation against the Funding Recipient regarding the Project or that may affect the Project in any way. Final inspection of the completed work on a project by a Registered Civil Engineer, in accordance with Standard Condition D.18, “Final Inspections and Certification of Registered Civil Engineer.” Funding Recipient shall notify the State’s Project Manager of the inspection date at least 14 calendar days prior to the inspection in order to provide State the opportunity to participate in the inspection.
NOTIFICATION OF STATE. PacifiCorp shall notify the Oregon Emergency Response System within 24 hours of an event with a verbal report on location, duration, and effect on water quality and aquatic life. If PacifiCorp observes or suspects that fish or wildlife or their habitat may be harmed, it shall immediately notify and consult with the hydropower coordinator and watershed biologist at ODFW’s Roseburg office. In no case shall such contact occur later than the next business day. Additionally, PacifiCorp shall provide an annual report to ODEQ and ODFW by March 1 for the preceding calendar year, describing each event and action taken to remediate impacts and the operational changes taken or proposed to reduce the reoccurrence of the spill or discharge.
