Your price does not include Distribution Charges or other EDC charges, applicable Pennsylvania sales tax or any local tax nor any other governmental or Independent System Operator charges. You are responsible for any and all taxes (whether passed through to you on EDC’s bill as a separate line item or as part of the price of electricity, as required by law, rule or regulation) and EDC charges for delivery and distribution services. Except as otherwise provided in this Agreement or as required by law, all taxes of whatsoever kind, nature and description, due and payable with respect to your performance of your obligations under this Agreement, will be paid by you. If you are a tax-exempt entity, you must provide Nittany Energy with the necessary certificates and other documentation to qualify for such status. Variable Rate Plan: Your price may fluctuate each month based on wholesale market conditions in PJM’s service territory. The variable price your electric supply service each month will be calculated by multiplying the variable price of electricity per kilowatt hour (kWh) that month by the amount of electricity you use in the billing cycle plus any applicable fees, charges or taxes. There is no price ceiling on a variable rate. THE PURPOSE OF THIS AGREEMENT IS TO AUTHORIZE NITTANY ENERGY TO SWITCH YOUR ELECTRIC GENERATION SERVICE AND YOU AUTHORIZE NITTANY ENERGY TO TAKE ALL ACTIONS NECESSARY TO ENROLL YOU WITH NITTANY ENERGY’S ELECTRIC GENERATION SERVICE.
Fixed Rate Plan. If your Contract Summary indicates that you have chosen a SmartBudget electric or natural gas product, the rate for the electricity and/or natural gas supplied to you by IDT Energy during the Fixed Rate Billing Cycles of this Agreement (as that term is defined in your Contract Summary), will be the fixed rate set forth on your Contract Summary. After the Fixed Rate Billing Cycles have ended, the rate will be a variable rate which may change monthly at IDT Energy’s discretion based on the factors detailed above in the description of the Variable Rate Plan. Rebate Programs: From time-to-time IDT Energy may offer a rebate program for new customers who enroll with IDT Energy and maintain active accounts with IDT Energy for a specified period of time. To be eligible to earn a rebate under any such rebate program, Customer will have 60 days to complete a validation process in accordance with the instructions that will be provided to Customer. Customer will also have to be an active customer of IDT Energy, in good standing, at the time the rebate is to be issued in order to qualify for the rebate. Rebate amounts appearing in IDT Energy’s advertising materials or presented orally to potential customers are merely examples of rebate amounts that customers might be eligible to receive. The actual amount of any rebate will be computed by reference to Customer’s actual usage over the term of this Agreement, which may vary substantially from any estimate provided. Any rebate earned by Customer will be sent to Customer at the address provided by Customer during the validation process. Rebates can be issued in a variety of forms including, but not limited to, checks, stored-value cards, or electronic gift cards. Stored-value cards and electronic gift cards will be issued by an issuing bank, pursuant to a direct relationship between Customer and the issuing bank, and will be subject to the terms and conditions of a Cardholder Agreement. Stored-value cards and electronic gift cards will expire 6 months after issuance. Renewable/Green Energy Option: If you have chosen the Renewable/Green Energy Supply option, IDT Energy will ensure that 100% of your electricity usage is matched with renewable energy certificates. Fixed Rate Plan. If Customer has chosen a Fixed Rate product, Customer Price per kWh is guaranteed not to change during Initial Term. Following the end of the Initial Term, and unless an alternative pricing provision is negotiated between the Parties, the Price for Service shall thereafter be variable month to month Agreement.

Your fixed rate will be no greater than 5% above the LDU’s posted 12-month historical rolling average of LDU default supply rates on the day you execute this Agreement. Fixed Rate Plan. If Customer has chosen a Fixed Rate product, Customer Price per Ccf is guaranteed not to change during Initial Term. • Variable Rate Options Variable Rate. If Customer has chosen a variable rate product, Customer Price per Ccf will be established and may vary each month, based upon such factors as natural gas market pricing, transportation or transmission costs, utility charges and other market price related factors, plus all applicable state, local, and use taxes. If Customer’s Local Utility pro-rates between months, and if a billing cycle spans across multiple months, Customer’s Local Utility will apply the Variable Rates pro-rated based on the Local Utilities billing methodology. The Variable Rate will be set in NAP's discretion and may vary from month to month based on NAP's assessment of applicable market conditions, and publicly available data and indices, historic and projected supply and hedging costs, prior months pricing and balancing costs, projected average customer bill amounts and Local Utility pricing. Customer’s Variable Rate may include the following additional costs: balancing costs, transportation costs, line loss costs, storage costs, pooling charges, credit costs, and a profit margin determined in NAP's discretion that may vary from month to month, but will not exceed forty (40) cents of the preceding calendar month (prior to the effect of any utility pro- rata billing methodology). Customer Variable Price may be higher or lower than the price offered in the initial or any following months while NAP is providing Supply Service. Savings are not guaranteed. Customer may contact NAP at its contact Information to obtain previous months rates. At any time, Customer may ask NAP to convert Customer rate plan from Variable to Fixed at NAP’s then current Fixed Rate, if available.

THERE IS NO LIMIT TO THE VARIABLE RATE OR HOW MUCH IT WILL CHANGE FROM ONE BILLING CYCLE TO THE NEXT, AND IT MAY BE HIGHER THAN THE STANDARD OFFER SERVICE RATE CHARGED BY THE UTILITY. You may also pay a monthly administrative fee, the amount of which, if applicable, is disclosed in your Contract Summary. You can access your upcoming variable rate up to 12 days before the start of the next billing period at xxxxx://xxx.xxxxxxxxxxx.xxx/mdvariablerates/. The rate you pay Company will include the Generation Charge and Transmission Charge, if applicable. If your plan includes a green, carbon neutral, or renewable component, then Company will purchase and retire renewable energy certificates (“RECs”), carbon offsets, verified emission reductions or other instruments or attributes to ensure that a specified percentage of your electricity usage, as disclosed in your Contract Summary if applicable, is offset. The renewable, green or carbon neutral content of your plan, if applicable, is specified in your Contract Summary.
