Energy Crisis. Should any future energy crisis result in the District taking action which affects the terms and conditions of employment of members of the bargaining unit, the District agrees that, insofar as it is possible to do so, it shall first notify the Association of the action to be taken and meet with them to negotiate the effect such action will have upon members of the bargaining unit.

Energy Crisis. As a result of an energy crisis which produces recommendations, requests or directives from the President of the United States, the Governor of the State of Maine, the Congress of the United States, the Legislature of the State of Maine or any of the various administrative departments and commissions of the Federal or State government, there may arise during the term of this Collective Bargaining Agreement a need for amendment. Such amendment may include changes in the normal work day or work week or the normal starting and ending hours. In the event of any recommended, requested, or directed change in any of the working conditions, the parties hereto shall meet and confer in order to formalize an amendment to this Collective Bargaining Agreement outlining the specific changes herein and to reduce the same to a written amendment of this contract. In the event that any such changes shall impose any undue hardship on any employee or employees, the parties hereto will meet and confer in an attempt to redistribute daily or weekly work loads so as to minimize the hardship; it being understood, however, that the principal objective of the parties hereto is the furnishing of high quality services to the citizens of Lewiston. In the event that the consultation referred to above shall fail to produce mutual agreement within a ten (10)-day period after the initial conference, the Employer may institute reasonable changes which shall be subject to review and adjustment and/or revision by the State Board of Arbitration and Conciliation without proceeding under the grievance procedures in the contract, provided, however, that any deviations from the terms of this Agreement shall be necessary to carry out the intent of this provision. Such revision shall be expedited and shall result in just compensation to any employees who have been harmed by the adjustments.

  • Renewable Energy Credits 5.01. Customer shall offer PMPA and/or Utility a first right of refusal before selling or granting to any third party the right to the Green Attributes associated with its customer-owned renewable generation that is interconnected to Utility’s electric distribution system. The term Green Attributes shall include any and all credits, certificates, benefits, environmental attributes, emissions reductions, offsets, and allowances, however entitled, attributable to the generation of electricity from the customer owned-renewable generation and its displacement of conventional energy generation.

  • Energy 1. Cooperation shall take place within the principles of the market economy and the European Energy Charter, against a background of the progressive integration of the energy markets in Europe.

  • Energy Conservation The Contractor agrees to comply with mandatory standards and policies relating to energy efficiency which are contained in the state energy conservation plan issued in compliance with the Energy Policy and Conservation Act.

  • Electric Storage Resources Developer interconnecting an electric storage resource shall establish an operating range in Appendix C of its LGIA that specifies a minimum state of charge and a maximum state of charge between which the electric storage resource will be required to provide primary frequency response consistent with the conditions set forth in Articles 9.5.5, 9.5.5.1, 9.5.5.2, and 9.5.5.3 of this Agreement. Appendix C shall specify whether the operating range is static or dynamic, and shall consider (1) the expected magnitude of frequency deviations in the interconnection; (2) the expected duration that system frequency will remain outside of the deadband parameter in the interconnection; (3) the expected incidence of frequency deviations outside of the deadband parameter in the interconnection; (4) the physical capabilities of the electric storage resource; (5) operational limitations of the electric storage resources due to manufacturer specification; and (6) any other relevant factors agreed to by the NYISO, Connecting Transmission Owner, and Developer. If the operating range is dynamic, then Appendix C must establish how frequently the operating range will be reevaluated and the factors that may be considered during its reevaluation. Developer’s electric storage resource is required to provide timely and sustained primary frequency response consistent with Article 9.5.5.2 of this Agreement when it is online and dispatched to inject electricity to the New York State Transmission System and/or receive electricity from the New York State Transmission System. This excludes circumstances when the electric storage resource is not dispatched to inject electricity to the New York State Transmission System and/or dispatched to receive electricity from the New York State Transmission System. If Developer’s electric storage resource is charging at the time of a frequency deviation outside of its deadband parameter, it is to increase (for over-frequency deviations) or decrease (for under-frequency deviations) the rate at which it is charging in accordance with its droop parameter. Developer’s electric storage resource is not required to change from charging to discharging, or vice versa, unless the response necessitated by the droop and deadband settings requires it to do so and it is technically capable of making such a transition.

  • CERTIFICATION REGARDING BOYCOTTING CERTAIN ENERGY COMPANIES (Texas law as of September 1, 2021) By submitting a proposal to this Solicitation, you certify that you agree, when it is applicable, to the following required by Texas law as of September 1, 2021: If (a) company is not a sole proprietorship; (b) company has ten (10) or more full-time employees; and (c) this contract has a value of $100,000 or more that is to be paid wholly or partly from public funds, the following certification shall apply; otherwise, this certification is not required. Pursuant to Tex. Gov’t Code Ch. 2274 of SB 13 (87th session), the company hereby certifies and verifies that the company, or any wholly owned subsidiary, majority-owned subsidiary, parent company, or affiliate of these entities or business associations, if any, does not boycott energy companies and will not boycott energy companies during the term of the contract. For purposes of this contract, the term “company” shall mean an organization, association, corporation, partnership, joint venture, limited partnership, limited liability partnership, or limited liability company, that exists to make a profit. The term “boycott energy company” shall mean “without an ordinary business purpose, refusing to deal with, terminating business activities with, or otherwise taking any action intended to penalize, inflict economic harm on, or limit commercial relations with a company because the company (a) engages in the exploration, production, utilization, transportation, sale, or manufacturing of fossil fuel-based energy and does not commit or pledge to meet environmental standards beyond applicable federal and state law, or (b) does business with a company described by paragraph (a).” See Tex. Gov’t Code § 809.001(1).
