Data Service. This section applies only to those customers who subscribe to Data Services from Ziply Fiber.
Data Service. LiveVol will use commercially reasonable efforts to make available to Subscriber via one or more application programming interfaces (collectively, the “API”), one or more information Service specified by Subscriber in one or more API Order Form(s) (collectively, the “Service”). The Service includes data and other information provided by third-party suppliers (each a “Data Supplier”) and/or LiveVol (any and all such data and information provided via the API collectively, “Data”). Subscriber shall submit an API Order Form to specify the desired Service, and a new API Order Form for any new Service it desires to receive.

Qwest will be charged for time spent by its End User while connected to the data connection, including time spent browsing on the Internet and reviewing or scrolling through Internet information on-line while connected to the Network.
Data Service. If and when data service becomes available and if selected by you, you will have access to data service. Neither we nor the Network Provider provisioning wireless and data service on our behalf is a publisher of third party content that may be accessed through your wireless phone or other device. You agree that neither we nor that company is responsible for any content, including information, opinions, advice, statements or services that are provided by third parties and accessible through your wireless phone or device. There are no guarantees provided concerning the accuracy, completeness, or usefulness of the information that may be obtained through your use of the data services. Due to the transmission method we utilize, your wireless phone number or similar identification or information may be transmitted over the Internet when using SMS. In addition, when utilizing text messaging, you agree to comply with all applicable laws and/or regulations of any governmental agency. ♦ You agree to pay all access, usage, and other charges and fees we bill you or that the user of your wireless phone accepted, even if you were not the user of your wireless phone and did not authorize its use. These include Federal Universal Service Charges and Regulatory Charges, and may include other charges which help us recover or defray costs we incur in complying with various government regulations and initiatives. We set these charges. They are not taxes or other government-imposed assessment, are not required by law, are kept by us in whole or in part, and are subject to change without notice. You may have to pay fees to begin service or reconnect suspended service. Usage charges may vary depending on where, when, and how you call. You have a home rate area and a local calling area (which may be different). When you call from inside a local calling area to somewhere outside of it, or call from anywhere outside a local calling area, there may be toll, regional calling, or long distance charges in addition to airtime (We provide or select the long distance service for calls on the network.). When you make a call inside your local calling area that uses a local phone company's lines (for example, a call to a typical home phone number), we may charge landline or connection fees. We charge airtime for most calls, including toll-free and operator assisted calls. Data Service. 15.1 The Service is a data service and not a telecommunications service and as such it is provided on a best efforts basis. While be attempt to minimized disruptions to the Service there are things beyond our control that may affect the Service.

Related to Data Service

Our Service We can act both as agent of the insurer, and on behalf of you, the customer. We have in place management controls to deal with any conflicts of interest that might arise. Unless we advise you otherwise, we are acting on your behalf. We also act on behalf of insurers when collecting premiums under risk transfer. Our service includes advising you on your insurance needs, arranging insurance cover with insurers or other intermediaries to meet your requirements and assisting you with any ongoing changes that you may have to make. As part of our service we will assist you with any claim that you need to make. If we use the services of another intermediary to place your insurance we will advise you of the name of the intermediary we use and the name of the insurer. Where it is agreed that we will only provide advice, or are appointed to act for you in respect of a particular aspect or aspects of risk we will make this clear in any correspondence with you and cannot be held liable for inadequacies in any other risk prevention measures you may have in place. If you mislay your policy at any time, we will arrange a replacement policy document, if you request it. We may make a charge for this.
Telephone Service Notwithstanding any other provision of this Lease to the contrary:
Customer Service It is the sole responsibility of MP to provide customer service to persons or entities purchasing Services through the ICQ Network ("Customers"). MP will bear full responsibility for all customer service, including without limitation, order processing, billing, fulfillment, shipment, collection and other customer service associated with any Services offered, sold or licensed through the MP Areas, and ICQ will have no obligations whatsoever with respect thereto. MP will receive all emails from Customers via a computer available to MP's customer service staff and generally respond to such emails within three (3) days from receipt. MP will receive all orders electronically and generally process all orders within three (3) days from receipt, provided Services ordered are not advance order items. MP will use commercially reasonable efforts to receive, process, fulfill and deliver all orders of Services on a timely and professional basis. MP will offer ICQ Users who purchase Services through such MP Areas a money back satisfaction guarantee, to the same extent offered by MP generally MP will bear all responsibility for compliance with federal, state and local laws in the event that Services are out of stock or are no longer available at the time an order is received. MP will also comply with the requirements of any federal, state or local consumer protection or disclosure law. Payment for Services will be collected by MP directly from customers.
Provider Network The MCO must enter into written contracts with properly credentialed Providers as described in this Section. The Provider contracts must comply with the Uniform Managed Care Manual's requirements, and include reasonable administrative and professional terms. The MCO must maintain a Provider Network sufficient to provide all Members with access to the full range of Covered Services required under the Contract. The MCO must ensure its Providers and Subcontractors meet all current and future state and federal eligibility criteria, reporting requirements, and any other applicable rules and/or regulations related to the Contract. The Provider Network must be responsive to the linguistic, cultural, and other unique needs of any minority, elderly, or disabled individuals, or other special populations served by the MCO. This includes the capacity to communicate with Members in languages other than English, when necessary, as well as with those who are deaf or hearing impaired. The MCO must seek to obtain the participation in its Provider Network of qualified providers currently serving the Medicaid and CHIP Members in the MCO's proposed Service Area(s). Medicaid MCOs utilizing Out-of-Network providers to render services to their Members must not exceed the utilization standards established in 1 T.A.C. §353.4. HHSC may modify this requirement for Medicaid MCOs that demonstrate good cause for noncompliance, as set forth in §353.4(e)(3). The MCO must seek participation in the Provider Network from the following types of entities that may serve American Indian and Alaskan Native children:
Network Organization grants to Keyholder (i) a limited non-exclusive, non-transferable, revocable sub-license to use the network (the “Network”), the use of which Organization licenses from UTC Fire & Security Americas Corporation, Inc. (“Supra”), which is necessary for the use and operation of the XpressKEY or eKEY (collectively, “Key”) for the Term shown on page 4 of this Agreement and (ii) a limited, non-exclusive, nontransferable, revocable sub-license to use the software Organization licenses from Supra (the "Software") for the Term.
Security Service Tenant acknowledges and agrees that, while Landlord may patrol the Project, Landlord is not providing any security services with respect to the Premises and that Landlord shall not be liable to Tenant for, and Tenant waives any claim against Landlord with respect to, any loss by theft or any other damage suffered or incurred by Tenant in connection with any unauthorized entry into the Premises or any other breach of security with respect to the Premises.
Universal service 1. Each Party has the right to define the kind of universal service obligations that it wishes to maintain. 2. Each Party shall administer any universal service obligation that it maintains in a transparent, non-discriminatory, and competitively neutral manner and shall ensure that its universal service obligation is not more burdensome than necessary for the kind of universal service that it has defined.
Beta Services From time to time, We may invite You to try Beta Services at no charge. You may accept or decline any such trial in Your sole discretion. Beta Services will be clearly designated as beta, pilot, limited release, developer preview, non-production, evaluation or by a description of similar import. Beta Services are for evaluation purposes and not for production use, are not considered “Services” under this Agreement, are not supported, and may be subject to additional terms. Unless otherwise stated, any Beta Services trial period will expire upon the earlier of one year from the trial start date or the date that a version of the Beta Services becomes generally available. We may discontinue Beta Services at any time in Our sole discretion and may never make them generally available. We will have no liability for any harm or damage arising out of or in connection with a Beta Service.
Availability of Verizon Telecommunications Services 3.1 Verizon will provide a Verizon Telecommunications Service to Reconex for resale pursuant to this Attachment where and to the same extent, but only where and to the same extent, that such Verizon Telecommunications Service is provided to Verizon’s Customers.

Because EnergyGateway has no control over such sites and resources, User acknowledges and agrees that EnergyGateway is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. User further acknowledges and agrees that EnergyGateway shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
