Cyber Risk Liability Insurance. The Contractor shall maintain coverage for Cyber Risk Liability, including information theft, computer and data loss replacement or restoration, release of private information, alteration of electronic information, notification costs, credit monitoring, forensic investigation, cyber extortion, regulatory defense (including fines and penalties), network security, and liability to third parties from failure(s) of contractor to handle, manage, store, and control personally identifiable information belonging to others. The policy must include full prior acts coverage. The coverage limits must be at least $1,000,000 per covered claim without sublimit, $2,000,000 annual aggregate.

Such insurance shall include coverage for Claims or Liabilities arising from network risks (including data breaches, unauthorized access/use, ID theft, invasion of privacy, loss/theft of electronic information, release of private information, damage to or alteration of electronic information, degradation, downtime, extortion, and network security) and intellectual property infringement, including infringement of copyright, trademark, service mark and trade dress and interruption of or damage to SCADA systems. The insurance also shall provide coverage for breach response costs, defense costs, regulatory fines and penalties, and credit monitoring expenses with limits sufficient to respond to these obligations. No exclusions shall be listed within the policy for unencrypted or portable devices. Notwithstanding any other provision of this Agreement, such policy shall remain in place during the Term, including any applicable maintenance period. Policy or policies shall also explicitly include all Contractor Parties. In the event of loss under this coverage, Contractor shall notify Company no later than 24 hours after discovery of any breach and will provide Company with access to data.

No exclusions shall be listed within the policy for unencrypted or portable devices. Notwithstanding any other provision of this Agreement, such policy shall remain in place during the Term, including any applicable maintenance period. Policy or policies shall also explicitly include all Contractor Parties. In the event of loss under this coverage, Contractor shall notify Company no later than 72 hours after discovery of any breach and will provide Company with access to data.

The policy shall include coverage for liability as a result of a data security breach or violation of consumer data protection laws arising out of Services provided under this Master Contract and resulting Purchase Orders - Limits are $1,000,000 per occurrence and $2,000,000 aggregate. The insurance coverage limits set forth herein are the minimum. Contractor’s insurance coverage shall be no less than the minimum amounts specified. Coverage in the amounts of these minimum limits, however, shall not be construed to relieve Contractor from liability in excess of such limits.

Such insurance shall cover any and all errors, omissions or negligent acts arising in or connected with the performance of the Scope of Work under this Agreement. Such cyber risk liability insurance shall include coverage of claims and losses with respect to network risks (such as data breaches, unauthorized access/use, ID theft, invasion of privacy, damage/loss/theft of data, degradation, downtime, etc.), failure to supply, and intellectual property infringement, such as copyrights, trademarks, service marks and trade dress. No exclusions shall be listed within the policy for unencrypted, media or portable devices. Notwithstanding any other provision of this Agreement, Contractor shall purchase and maintain extended reporting period coverage providing that claims first made and reported to the insurance company within two (2) years after termination of the Agreement or cancelation of the insurance policy (and without new policy having the same retroactive date as the effective date of this Agreement) will be deemed to have been made during the policy period. Policy or policies shall also explicitly include subcontractors.
Cyber Risk Liability Insurance. LIABILITY AND PROPERTY LOSS FOR DATA BREACHES. CYBER risk insurance, on a claim form. This coverage shall include Contractual Liability insurance for the indemnity provided under this Master Contract. Limits are $2,000,000 per occurrence and $4,000,000 aggregate. The insurance coverage limits set forth herein are the minimum. Contractor’s insurance coverage shall be no less than the minimum amounts specified. Coverage in the amounts of these minimum limits, however, shall not be construed to relieve Contractor from liability in excess of such limits. Contractor waives all rights against the State of Washington for the recovery of damages to the extent such damages are covered by any insurance required herein.

The policy must include full prior acts coverage. The coverage limits must be at least $10,000,000 per covered claim without sublimit, $10,000,000 annual aggregate. Cyber Risk Liability Insurance. If required in Exhibit “C”-Scope of Work, Subcontractor shall provide cyber-risk liability insurance for data breach and unauthorized privacy disclosures with limits of at least $2,000,000 per claim/aggregate and coverage equivalent or superior to ISO form endorsement CG 00 65 (12/07).
