Confidentiality of Customer Information. MERCHANT further warrants and agrees that it shall not sell, purchase, provide, or exchange checking account information in the form of sales drafts, mailing lists, tapes, or any other media obtained by reason of a transaction or otherwise, to any third party other than to SPS-EFT, MERCHANT’s agents approved by SPS-EFT for the purpose of assisting MERCHANT in its business to SPS-EFT, the financial institution named on the check, or pursuant to lawful government demand without the account holder’s explicit written consent. All media containing checking account numbers must be stored in an area limited to selected personnel until discarding and must be destroyed prior to or in connection with discarding in a manner that will render the data unreadable. MERCHANT will not disclose and will keep confidential the terms and conditions of this Agreement.

Confidentiality of Customer Information. The names, addresses and other information concerning Customers are and shall remain the sole property of Service Provider. Neither the Distributor, Janus Services, their affiliates, nor their officers, directors, employees or agents, or any control person of the foregoing persons, shall use such names, addresses or other information for any purpose except in connection with the performance of the Distributor's and Janus Services' duties and responsibilities hereunder and except for shareholder servicing and informational mailings relating to the Funds. Notwithstanding the foregoing, this Section 11 shall not prohibit the Distributor, Janus Services or any of their affiliates from using for any purpose the names, addresses or other information concerning any of Service Provider's Customers if such names, addresses or other information are obtained in any manner other than from Service Provider pursuant to this Agreement. The provisions of this Section 11 shall survive termination of this Agreement.

Notwithstanding the foregoing, this Section 8 shall not prohibit Strong or any of its affiliates from utilizing for any purpose the names, addresses or other information concerning any of Broker-Dealer's Customers if such names, addresses or other information are obtained in any manner other than from Broker-Dealer pursuant to this Agreement. The provisions of this Section 8 shall survive the termination of this Agreement.
Confidentiality of Customer Information. The Contractor shall ensure Contingent Staff’s compliance with all State and federal confidentiality requirements of the Department and Customer, including any requirements pertaining to protected health information (PHI), as defined in the Health Insurance Portability and Accountability Act of 1996 (HIPAA), if applicable. The Contractor shall comply with any additional confidentiality requirements set forth in the Customer’s contract or purchase order.
