The Bar Examination clause defines the requirements and procedures related to the professional licensing exam for lawyers. It typically outlines eligibility criteria, application processes, and the standards candidates must meet to sit for and pass the bar exam, such as educational prerequisites or character assessments. Bar Examination. A law school graduate will not be discharged solely for a first failure to pass the bar examination. TLDEF will provide one (1) month paid time off for those taking the bar for a second time. In the event a law graduate fails to pass the bar examination upon the second attempt, they will be transferred to an existing and open bargaining unit non-attorney position. The vacant non-attorney position must be one that the law school graduate meets the list of qualifications for as outlined in the job description. If the law school graduate is successful in passing the bar examination on a third attempt, upon admission to the bar, they will have recall rights to the job from which they were terminated for one (1) year following their date of termination, subject to hiring needs. Staff Attorneys who are rehired after passing the bar examination following termination after two bar failures will be given service credit for each month actually worked as a law school graduate prior to termination.
Bar Examination. A law graduate shall not be fired solely for the first failure of the bar examination. All law graduates (including staff admitted in another jurisdiction or jurisdictions but not in New York) required by NYLAG to be licensed to practice law in New York State shall be required to take the next available exam following commencement of their employment and/or their failure of the exam. Any employee who does not sign up and take the next available bar exam after failure shall be terminated, absent extraordinary circumstances, and such termination shall not be subject to Article 1.9
Bar Examination. Law Graduates shall be required to take the next Tennessee Bar Examination offered after their graduation for which they are eligible. If a Law Graduate fails to pass the Bar Examination the first time, the individual will be required to take the next Bar Examination offered. Unless waived by the Executive Director and/or designee for good cause shown, a Law Graduate shall be discharged upon failure to pass the second Bar Examination. Discharge for failure to pass the second Examination is not a grievable issue.

All law graduates required to be licensed to practice law in New York State shall be required to take the next available exam following commencement of their employment and/or their failure of the first exam. A law graduate shall be terminated if they fail the bar a second time. NYLAG will consider any such law graduate for any open, non-attorney bargaining unit positions, and will take their experience at NYLAG into account for any paralegal opening within such law graduate’s program, for which they meet the qualifications of the position. Employees taking the exam the second time, shall be given two weeks unpaid leave, for the purposes of studying for the second exam, in addition to using any other appropriate paid time off.
