The Vacation Denial clause establishes the employer's right to refuse or postpone an employee's request for vacation time under certain circumstances. Vacation Denial. When an employee’s vacation cannot be approved, the next earliest alternative date requested by the employee, if available and deemed possible by the supervisor, shall be approved.
Vacation Denial. Employees who have requested and were denied vacation within twenty- eight (28) days (two (2) payroll periods) of reaching their vacation accrual maximum, shall be allowed an additional forty-two (42) days (three (3) payroll periods) upon reaching the maximum during which vacation accrual shall continue. The employee shall be scheduled consecutive time off in twenty-four (24) hour increments during the sixty (60) day extension period sufficient to place the employee below the vacation accrual maximum. Department Heads shall be responsible for promptly notifying the Administrative Services Department when employees qualify for additional time to accrue vacation under this provision.
Vacation Denial. When an employee’s vacation cannot be approved, the supervisor shall schedule the employee’s vacation at the next earliest date requested by the employee if available and deemed possible by the supervisor. . If an employee’s request for vacation leave is denied, the Employer, upon request, must provide the reason for denying vacation leave electronically or in writing.
Vacation Denial. All vacation times requested are subject to the needs of the agency. However, denial of a requested vacation period shall not be arbitrary and shall not unreasonably defer the taking of vacations so that for all practical purposes the officer is deprived of vacation rights.

a. An employee must have at least the minimum accumulated vacation hours as set forth in the chart above, by the end of the pay period that includes June 1st or November 1st of each calendar year in order to be eligible for payment. Payment shall be made on the next regularly scheduled pay date following the dates above.
b. The employee shall submit a written request on a form, provided by the Employer, with the time sheet for the pay period that includes June 1st and November 1st. The Employer shall verify the employee’s years of service, the employee’s accumulated hours, and will pay the specified vacation hours, in multiples of five (5) hours per the chart above, for the proper years of service.
c. The vacation hours taken as pay will be paid at straight time and shall not be counted as hours worked for the computation of overtime.
d. An employee submitting requests outside the parameters listed above shall not be paid. All other provisions of this section continue to apply.
