COST/FUNDING SOURCE N/A DISCUSSION Tampa Bay Water is required to mitigate the historic impact to one wetland on the boundary of the Cypress Creek Wellfield in order to complete the renewal of the Consolidated Water Use Permit. This wetland cannot be mitigated onsite due to flooding concerns on adjacent properties. Tampa Bay Water has remaining wetland mitigation credits at the Model Dairy property that it wishes to withdraw as mitigation for the impact to the single wetland. Hillsborough County owns the Model Dairy property and Tampa Bay Water's agreement with the County for access to this property for monitoring and maintenance of the wetlands expired in January 2013. The Southwest Florida Water Management is requiring a new perpetual access agreement between Hillsborough County and Tampa Bay Water in order to authorize the use of Model Dairy wetland mitigation credits and renew the Consolidated Permit. Hillsborough County originally intended to grant the District a Conservation Easement over the Model Dairy property, as the District had previously stated that was their preferred approach. The agreement would also have granted perpetual access rights to Tampa Bay Water for wetland maintenance. The District has since directed that the agreement is to be between Hillsborough County and Tampa Bay Water without the District being a party to the agreement. Tampa Bay Water and County staff are working to finalize the agreement format to meet District requirements and complete a perpetual exclusive easement agreement. The draft agreement as of the date of this agenda item is attached to this agenda item. Hillsborough County staff presented the request for this new access agreement to the Environmental Lands Acquisition and Protection Program (ELAPP) Citizens Board at their October 4, 2021 meeting and the board supported the staff recommendation. Suggested Action. Contractors should reject an acceleration instruction formally in writing if no provision in the agreement exists and must inform the principal agent that it is not a valid contract instruction in terms of the JBCC. Also, they should make clear they have no obligation or intention to proceed with it. If the principal agent disagrees, the parties can refer the matter to dispute resolution This does not mean that acceleration is prohibited as an option between parties in a JBCC agreement. The parties can still negotiate and agree on a form of acceleration between them. This can sometimes be a positive negotiation to the benefit of the project. Many contractors also prefer to quote on acceleration rather than claim a revision of the date for practical completion, and it can therefore provide a win-win opportunity for the parties if handled correctly. However, it is important to appreciate the contractual boundaries and if an acceleration negotiation is contemplated, it is strongly advised to get legal help in drafting an amendment
Suggested Action. The District requests entering into an agreement with CORE Districts and its subcontractor Educational Analytics in order to receive professional and peer learning services, and participation in the CORE Policy Analysis for California Education (PACE) research collaborative.
