Utility Agreement definition

Utility Agreement means an agreement between the Authority and the Facility Owner, authorizing and providing for the performance of specific work and/or services and/or the purchase of materials and equipment.
Utility Agreement means an agreement entered into under section 154 and, if that agreement is amended under section 158, that agreement as so amended;
Utility Agreement means the agreements with Utility Owners.

More Definitions of Utility Agreement

Utility Agreement means a single agreement as required by Subsection 54-17-903(2)(b) entered into prior to the filing date of the application for Commission approval of the program between the utility and all eligible communities that intend to become participating communities.1
Utility Agreement means a XXXX or UAAA, as the context may require. Advance Utility Relocation Agreements are not a Utility Agreement. Capitalized terms used in the Contract Documents but not otherwise defined in this DBA shall have the meaning set forth in Section 1.2 of the General Conditions. If any definition set forth above is also included in Section 1.2 of the General Conditions, to the extent such definitions conflict, the definition in Section 1.2 of the General Conditions is hereby amended by the definition set forth above.

Utilities are either agreements where the Utility Owner has Prior Rights to be on the right of way and SCDOT is responsible for Utility Work costs, or encroachment permits where the Utility Owner does not have prior rights and where the costs for Utility Work is borne by the Utility Owner. Utility Agreements are “Prior Rights Contracts”, where a Utility Owner’s facility that has senior real property rights to SCDOT’s rights with respect to the utility facility’s location.
