Substitute Scales. 637 If any facility scale is inoperable, being tested, or otherwise unavailable, Contractor shall use Reasonable 638 Business Efforts to weigh vehicles on the remaining operating scale. To the extent that all the scales are 639 inoperable, being tested, or otherwise unavailable, Contractor shall substitute portable scales until the 640 permanent scales are replaced or repaired. Contractor shall arrange for any inoperable scale to be 641 repaired as soon as possible and, in any event, within five (5) Working Days of the failure of the 642 permanent scale. If repairs to the permanent scale are projected to take more than twelve (12) hours, 643 Contractor shall immediately obtain a temporary substitute scales(s).

Pending substitution of portable scales or during 479 power outages, CONTRACTOR shall estimate the Tonnage of Collected Material ▇▇▇▇▇▇ Valley Sanitary District 480 delivered to the Disposal Facility by utilizing the arithmetic average of that vehicle's 481 recorded Tons of Collected Material delivered on its preceding three (3) deliveries, on 482 the same day of the week, to the Disposal Facility, with the exception that the Tonnage 483 estimated in Roll-off Containers shall be made by multiplying the estimated number of 484 cubic yards of Collected Material delivered per Roll-off Container by 0.25 Tons per cubic 485 yard for mixed MSW and 1.0 Tons per cubic yard for loads of dirt, rubble, or rock 486 material or such other amounts as may be agreed to in writing between CONTRACTOR 487 and DISTRICT. 488 4.10.5.1 All information required by Sections 4.10.1 and 489 4.10.2 shall continue to be recorded for each delivery of Collected Material to the 490 Disposal Facility during any period the scales are out of service.

If there are no operable scales (for example, pending the installation of portable scales), County will estimate the quantity of transferable waste based on its choice of either of the following: • weights recorded upon delivery at the disposal facility, subject to audit and verification by County, or • estimated weights based on any or all of the following: o container volumes, o historical tare weights, and o either or both historical transfer station and disposal facility weight records.

Pending substitution of portable scales or during power outages, Contractor will 583 estimate the Tonnage of Authority’s Solid Waste delivered to the Landfill by utilizing the 584 arithmetic average of each vehicle's recorded Tons of Solid Waste delivered on its preceding three 585 (3) deliveries, on the same Day of the week, to the Landfill. 586 587 All information required by Section 4.09.G will continue to be recorded for each delivery of Solid 588 Waste to the Landfill and each Transported load of Solid Waste during any period the scales are 589 out of service. 590 591 E. Testing. Contractor will test and calibrate all scales in accordance with Applicable Law, but at 592 least every twelve (12) months. Upon Authority request, Contractor will promptly provide the 593 Authority with copies of test results. Contractor will further test and calibrate any or all scales 594 within three (3) Working Days of Authority direction. If test results indicate that the scale or scales 595 complied with Applicable Law, the Authority will reimburse Contractor the Direct Costs of the 596 tests. If the test results indicate that the scale or scales did not comply with Applicable Law, 597 Contractor will bear the costs thereof and Contractor will at its own cost adjust and correct, 598 consistent with the results of that test, all weight measurements recorded and Disposal Rates 599 calculated, charged, and paid, as the case may be, from the date of Authority’s direction. 600
