Safety Disputes Resolutions Procedure. The parties to this agreement are committed to continuous improvement in Occupational Health and Safety standards through the implementation of an organizational framework which involves all parties in protecting apprentice’s health and safety. In meeting these objectives, the parties have agreed to consider a broad agenda through the consultative processes established by this agreement. Such agenda will include Host Employers providing: ❖ Measures designed to ensure they adhere to the provisions of the Occupational Health and Safety Act 1985. ❖ Maintain a working environment that is safe and without risk to the health of the apprentices. ❖ Monitor the health of the apprentices. ❖ Keep information and records relating to the health and safety of the apprentices. ❖ Nominate a person with or persons each with a level of seniority to be the Host Employer’s representative or representatives. ❖ Monitor the conditions of the workplace. ❖ Ensure that the apprentices are supervised as outlined in the OCEI Supervision Guidelines for Apprentices Working on Electrical Installations. Provide the names of persons to whom the apprentice may make an injury report or complaint in relation health and safety. As soon as possible after any Occupational Health and Safety issue has been reported to the Host Employer, the Host Employer representative, elected OH&S representative and the company case manager shall meet to try to resolve the issue. If the matter is not resolved, the Companies OH&S manager will get involved in discussions in attempt to resolve the issue. If agreement is still not reached the following steps will be initiated by the company or an employee. When dealing with occupational health and safety and an issue arises, the matter should be referred to the company’s safety representative or supervisor. The supervisor shall discuss the matter with the person and the elected ETU health and safety representative if on site with a view to agreeing on a safe working procedure to eliminate the risk of injury or disease. Where the supervisor or the ETU health and safety representative consider there is likely to be an immediate risk to the health and safety of any person they may, jointly or singularly, direct that work in particular area, or by that particular method, cease (immediate risk means that there is a degree of danger which is likely to cause injury or disease before the risk can be eliminated).   • Disputes Procedure If a dispute relating to a Script licensed in accordance with this Agreement arises between the Writer and the BBC which cannot be settled by direct discussion then either party will have the right to refer the issue to a panel of five which shall be comprised of the Writer and their representative, two representatives from the BBC and an independent third party to be appointed by agreement between the Writer and the BBC. This clause shall not however be invoked in a manner which might override any other clause in this Agreement or call into question the BBC’s reasonable and proper discretion to exercise its editorial control over a Programme.

  • GRIEVANCE PROCEDURE & ARBITRATION 36.01 Any complaint, disagreement or difference of opinion between the Company and the Union, or the employees, which concerns the interpretation, application, operation or alleged violation of the terms and provisions of this Agreement, shall be considered as a grievance.

  • ARTICLE GRIEVANCE PROCEDURE The parties to this Agreement are agreed that it is of the utmost importance to adjust complaints and grievances as quickly as possible. Unless agreed to by both the Company and the Union, no grievance shall be presented, the alleged circumstances of which originated or occurred, or should have come to the attention of the employee concerned, more than five (5) working days prior to its original presentation in writing at Step A grievance shall consist of a dispute concerning interpretation and/or application of any Article, Schedule or Clause in this Agreement. Should a grievance arise it shall be handled as follows. Prior to filing a formal grievance, an employee will, with the assistance of his xxxxxxx, refer the on an informal basis to his immediate Supervisor. STEP Should the employee be dissatisfied with the disposition of the grievance at Step the grievance may be referred to the Plant Manager within five (5) working days after receipt of the immediate Supervisor's reply at Step The Plant Manager shall convene a meeting with the and Chief Xxxxxxx and shall answer the grievance in writing within five (5) working days of such meeting. STEP If no settlement is reached at Step the the Union Grievance Committee and representatives of Management shall meet to discuss the grievance within five (5) working days of receipt of the reply of the Plant Manager. The Union's National Representative will be in attendance at this meeting. If the grievance is not settled within five (5) working days it may be referred to arbitration as hereinafter provided. The Union or the Company may initiate a grievance beginning at Step of the Grievance Procedure. Such grievance shall be filed within five (5) working days of the incident giving rise to the complaint and be in the form prescribed in Step Any such grievance may be referred to arbitration under Article by either the Union in the case of a Union grievance or the Company in the case of a Company grievance. The Union may not institute a grievance directly affecting an employee or employees which such employee or employees could themselves institute and the regular Grievance Procedure shall not thereby be by-passed except where the grievance would affect the Bargaining Unit as a whole.
