Proof of Incapacity to Work. The employee shall prove to the satisfaction of the Company that the employee was unable on account of such illness or injury to attend for duty on the day or days for which personal leave for personal injury and sickness is claimed. Certificates of attendance at a dentist, chiropractor or optometrist or where referred by a medical practioner for any other attendance, are acceptable to a maximum duration of four hours per visit. Such absences will be deducted from accruals of personal leave for personal injury and sickness. Where necessary, and depending upon need, up to eight hours may be approved.

Proof of Incapacity to Work. An employer may require the employee to provide evidence in relation to a period of personal leave. The employee must then provide their employer with a medical certificate from a registered health practitioner. If it is not reasonably practicable to provide a medical certificate, the employee may provide a statutory declaration. The employer shall not be required to make any payment in respect of accumulated personal leave credits to an employee who is discharged or leaves his or her employment, or for any time an employee is absent from work without producing evidence sufficient to the employer of personal illness. The medical certificate must state that in the practitioner's opinion the employee was, is or will be unfit for work during the period because of personal illness or injury. If a statutory declaration is provided, it must state that the employee is, was or will be unfit to work due to personal illness or injury. If an employee cannot comply with the documentation requirements due to circumstances beyond their control, the employee will not have breached the Standard.

  • Proof of Illness A Board may request medical confirmation of illness or injury and any restrictions or limitations any Employee may have, confirming the dates of absence and the reason thereof (omitting a diagnosis). Medical confirmation is required to be provided by the Employee for absences of five (5) consecutive working days or longer. The medical confirmation may be required to be provided on a form prescribed by the Board. Where an Employee does not provide medical confirmation as requested, or otherwise declines to participate and/or cooperate in the administration of the Sick Leave Benefit Plan, access to compensation may be suspended or denied. Before access to compensation is denied, discussion will occur between the Union and the school board. Compensation will not be denied for the sole reason that the medical practitioner refuses to provide the required medical information. A school Board may require an independent medical examination to be completed by a medical practitioner qualified in respect of the illness or injury of the Board’s choice at the Board’s expense. In cases where the Employee’s failure to cooperate is the result of a medical condition, the Board shall consider those extenuating circumstances in arriving at a decision.

  • Proof of Sickness Sick leave with pay is only payable because of sickness or injury and employees who are absent from duty because of sickness may be required by the Employer to prove sickness. Failure to meet this requirement can be cause for disciplinary action. Repeated failure to meet this requirement can lead to dismissal. A doctor’s certificate may be requested for each leave of more than three (3) consecutive work days.

  • Proof of Disability The County shall have the right to require the submission of adequate medical proof of the employee's disability due to accident or illness. Should there be an extended period of disability, the County shall have the right to require periodic medical proof of the employee's disability.

  • Termination due to Force Majeure 13.5.1 If the Force Majeure Event or its effects continue to be present beyond the period as specified in Article 4.5.3, either Party shall have the right to cause termination of the Agreement.   • Termination Due to Force Majeure Event If the period of Force Majeure continues or is in the reasonable judgment of the Parties likely to continue beyond a period of 120 (one hundred and twenty) Days, the Parties may mutually decide to terminate this Agreement or continue this Agreement on mutually agreed revised terms. If the Parties are unable to reach an agreement in this regard, the Affected Party shall after the expiry of the said period of 120 (one hundred and twenty ) Days be entitled to terminate the Agreement in which event, the provisions of Articles 16 and 17 shall, to the extent expressly made applicable, apply.
