Ownership and Restrictions. 4.1 You retain all ownership and intellectual property rights in and to Your Content and Your Applications. Oracle or its licensors retain all ownership and intellectual property rights to the Services, including Oracle Programs and Ancillary Programs, and derivative works thereof, and to anything developed or delivered by or on behalf of Oracle under this Agreement.

Ownership and Restrictions. Oracle or its licensors retain all ownership and intellectual property rights in the Program. You may not: - remove or modify any Program markings or any notice of Oracle’s or its licensors’ proprietary rights; - make the Program available in any manner to any third party; - use the Program to provide third party training; - assign this Agreement or give or transfer the Program or an interest in them to another individual or entity; - cause or permit reverse engineering (unless required by law for interoperability), disassembly or decompilation of the Program (the foregoing prohibition includes but is not limited to review of data structures or similar materials produced by Programs); - create derivative works based on the Program; - disclose results of any Program benchmark tests without Oracle’s prior written consent; or - use any Oracle name, trademark or logo.

Except to the extent you or any Users make any of your Data accessible to other users or the public through the Menusifu System, your Data will be deemed to be your Confidential Information. Notwithstanding anything else in this Agreement, Menusifu may monitor your Users’ use of the Menusifu System and use your Data in an aggregated and anonymous manner, compile statistical and performance information related to the provision and operation of the Menusifu System and may make such information publicly available, provided that such information does not incorporate and/or identify your Confidential Information. Menusifu and its licensors retain all ownership and intellectual property rights to the Services, Menusifu Software, and anything developed and delivered under this Agreement, unless otherwise provided in your Order Form(s). Third party technology that may be appropriate or necessary for use with some Services or Menusifu Software is specified in the Documentation or the Order Form(s) as applicable. Your right to use such third party technology is governed by the terms of the third party technology license agreement specified by Menusifu and not under this Agreement.

Third party technology that may be appropriate or necessary for use with some Oracle programs and/or hardware is specified in the program documentation and/or hardware documentation and that such third party technology is licensed to you under the terms of the third party technology license agreement specified in the program documentation and/or hardware documentation and not under the terms of the end user agreement. Hardware and integrated software are not specifically designed, manufactured, or intended for use as parts, components, or assemblies for the planning, construction, maintenance, or operation of a nuclear facility and prohibit use of the hardware and/or integrated software for these purposes. Some programs may include source code that Oracle may provide as part of its standard shipment of such programs, which source code shall be governed by the terms of the end user agreement. You may not:  use of the programs for rental, timesharing, subscription service, hosting, or outsourcing;  remove or modify any program or hardware markings or any notice of Oracle’s or its licensors’ proprietary rights;  make the programs, operating system, integrated software available in any manner to any third party for use in the third party’s business operations (unless such access is expressly permitted for the specific program license);  transfer title to the programs, operating system and/or integrated software from you to any other party;  reverse engineer (unless required by law for interoperability), disassemble or decompile the programs (the foregoing prohibition includes but is not limited to review of data structures or similar material produced by progr...

You may not: • remove or modify any program markings or any notice of SkillsTX’s or its licensors’ proprietary rights; • make the programs or materials resulting from the services available in any manner to any third party for use in the third party’s business operations (unless such access is expressly permitted for the specific program licence or materials from the services you have acquired); • modify, make derivative works of, disassemble, reverse compile, or reverse engineer any part of the services (the foregoing prohibition includes but is not limited to review of data structures or similar materials produced by programs), or access or use the services in order to build or support, and/or assist a third party in building or supporting, products or services competitive to SkillsTX; • disclose results of any services or program benchmark tests without SkillsTX’s prior written consent; nor • license, sell, rent, lease, transfer, assign, distribute, display, host, outsource, disclose, permit timesharing or service bureau use, or otherwise commercially exploit or make the services, SkillsTX programs or materials available, to any third party other than as expressly permitted under the terms of the agreement. The rights granted to you under the agreement are also conditioned on the following: • the rights of any user licensed to use the services (e.g., on a “named user” basis) cannot be shared or used by more than one individual (unless such licence is reassigned in its entirety to another authorised user, in which case the prior authorised user shall no longer have any right to access or use the licence); • except as expressly provided herein, no part of the services may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including but not limited to...

You may not:  remove or modify any Program markings or any notice of Oracle’s or its licensors’ proprietary rights;  make the Programs, Materials, or deliverables resulting from the Services available in any manner to any third party for use in the third party’s business operations;  cause or permit reverse engineering (unless required by law for interoperability), disassembly or de-compilation of the Programs (the foregoing prohibition includes but is not limited to review of data structures or similar materials produced by Programs); or  disclose results of any Programs or Services benchmark tests without Oracle’s prior written consent.
Ownership and Restrictions. The word “programs” in the first sentence of the first paragraph of the Ownership and Restrictions section of the agreement is replaced by the phrase “programs, the operating system and integrated software”. Add the following as a new second sentence in the first paragraph of the Ownership and Restrictions section of the agreement: “Oracle or its licensors retain all intellectual property rights to the hardware.” In the second sentence of the second paragraph of the Ownership and Restrictions section of the agreement, the phrase “specified in the program documentation” is replaced by the phrase “specified in the program documentation or readme files”.
