Lactation Provisions. Employees who are lactating will be entitled to one paid break of 30 minutes per shift for the purposes of expressing their milk or breast feeding their child. MUH will provide access to suitable facilities for such purpose, in accordance with MUH’s policy. Transfer to a safe position Where, because of an illness or risk associated with the pregnancy, an employee cannot carry out the duties of their position, MUH is obliged, as far as practicable, to provide employment in some other position that the employee is able to satisfactorily perform. A position to which an employee is transferred under these circumstances must be as close as possible in status and salary to the employee’s substantive position. The employee must provide evidence that they are fit to work in the alternative position. Community Service Leave Entitlement to be absent from employment for engaging in eligible community service activity. An employee who engages in an eligible community service activity is entitled to be absent from their employment for a period if:

Sections 49 CFR 21 through Appendix C (2016) and 23 CFR 710.405(b) (2016) are applicable by reference in all contracts and subcontracts financed in whole or in part with Federal-aid highway funds. The CONSULTANT further agrees to furnish reports to the LOCAL AUTHORITY or DEPARTMENT upon request for the purpose of determining compliance with these statutes identified in this section. The CONSULTANT shall comply with the Americans with Disabilities Act (ADA). The CONSULTANT shall not discriminate on the basis of race, color, national origin, or sex in the performance of this contract. The CONSULTANT shall carry out applicable requirements of 49 CFR Part 26 (2016) in the award and administration of federal-aid contracts. Failure by the CONSULTANT to carry out these requirements is a material breach of this contract, which may result in the termination of this contract or such other remedy as the DEPARTMENT deems appropriate. During the performance of this contract, the CONSULTANT, for itself, its assignees and successors in interest agrees as follows:

  • Other Termination Provisions 1. We may deliver any notice instead of mailing it. Proof of mailing of any notice shall be sufficient proof of notice.

  • Violation of Non-discrimination provisions Violation of the non-discrimination provisions of this Agreement shall be considered a breach of this Agreement and subject the Contractor to penalties, to be determined by the County Manager, including but not limited to i) termination of this Agreement;
