General Scope. 1. This Convention shall apply only to persons who are residents of one or both of the Contracting States, except as otherwise provided in the Convention.
General Scope. Manager shall devote such efforts as are consistent with the Standard of Care (as defined below) in managing, coordinating and supervising the ordinary and usual business and affairs pertaining to the identification, acquisition, operation, maintenance, leasing, licensing, rehabilitation, construction, disposition and management of the Properties and in compliance with the directives of Owner or the Investment Committee (as hereinafter defined), all pursuant to the terms, conditions and limitations of this Agreement. Manager shall have such responsibilities, and shall perform and take, or cause to be performed or taken, all such services and actions customarily taken by managing agents of property of similar nature, location, and character to that of the Properties consistent with the duties set forth in this Article III. Unless otherwise specifically provided in this Agreement, the written directives of Owner or the Investment Committee, the Approved Guidelines, or the Approved Operating Budget (collectively, the “Guiding Documents”), all services and actions that Manager is required or permitted to perform or take, or cause to be performed or taken in connection with the management of the Properties shall be performed or taken, as the case may be, on behalf of Owner and at Owner’s sole cost, expense, and risk. Manager’s authority is limited to performing the services set forth herein and the other Guiding Documents. Except as provided in the Guiding Documents, Manager shall have no authority (a) to execute any contract or agreement for or on behalf of Owner, (b) to provide additional services or modify existing services to tenants, or (c) to assume or create any obligation or liability or to make any representation, covenant, agreement or warranty for or on behalf of Owner.

This Convention shall apply to interest paid by a Paying Agent established within the territory of one of the Contracting States with a view to enable savings income in the form of Interest Payments made in one Contracting State to Beneficial Owners who are individuals resident for tax purposes in the other Contracting State to be made subject to effective taxation in accordance with the laws of the latter Contracting State.
General Scope. 1. In addition to the procedure for the Network Development Plan Gas 2016, the transmission system operators GASCADE Gastransport GmbH, Gasunie Deutschland Transport Services GmbH and ONTRAS Gastransport GmbH jointly carried out a market survey from 21 August until 16 October 2015 under the name “more capacity” to determine the need for new transport capacities for high calorific natural gas at the boundaries of the GASPOOL market area. The aim of the market survey was to be able to estimate the future need for new cross-market-area transport capacities as early and as realistically as possible. Fluxys Deutschland GmbH has been involved in the “more capacity” project since April 2016; NEL Gastransport GmbH has also been involved in it since July 2016. Offering levels have been derived from the non-binding demand for cross-market-area capacities determined on the basis of the survey. The new technical capacities determined in the above manner are to be allocated in capacity auctions.
