Equipment Inspection. The Department shall determine the manner and prescribe the inspection of all Equipment and the tests of all samples submitted to determine whether they comply with all of the specifications in the Contract. If any Equipment fail in any way to meet the specifications in the Contract, the Department may, in its sole discretion, either reject it and owe nothing or accept it and pay for it on an adjusted price basis, depending on the degree to which the Equipment meets the specifications. Any decision pertaining to any such failure or rejection shall be final and binding.

Equipment Inspection. Xxxxxx agrees that it has been given the opportunity to inspect the Equipment on the Start Date and acknowledges the Equipment is in good working condition. Any exceptions to the above statement are identified below.
Equipment Inspection. The Contractor shall permit the Municipal Officers to inspect all equipment used for the plowing and removal of snow and sand application when they deem it necessary. In the event a piece of equipment is believed to be inadequate, the Contractor and Municipal Officers may engage the opinion of a neutral 3rd party to determine the adequacy of the equipment. Decisions of the 3rd party shall be final.

Subcontractor shall be responsible for any damages caused by delay unloading unless such delays are a direct result of acts or omissions of Company or the Customer.
Equipment Inspection. Customer agrees to inspect Equipment prior to use and to immediately notify PROBOX of any defect in writing. By using Equipment without providing PROBOX written notice of defect, Customer or Customer’s agent accept the Equipment as free of defects and in good repair.

Equipment Inspection. The Lessee will be responsible for the required statutory inspections of the rented Equipment by a recognized inspection body. A copy of the report will be immediately forwarded to Lessor. The Lessee must give the inspection body sufficient time to carry out the inspection during normal working hours. If the statutory inspection cannot take place within the statutory period due to Xxxxxx's actions or a circumstance for which the Lessee should be responsible, the Lessee is obliged to compensate the Lessor for all damage suffered by the Lessor as a result. The costs of the inspection are for the Lessor.

Equipment Inspection. Motor Carrier shall inspect General Purpose Equipment prior to leaving the Terminal in accordance with Section D(3) of the UIIA. Motor Carriers shall not interchange equipment that possesses a visible and audible roadability defect. Damage to General Purpose Equipment must be noted on the Equipment Interchange Receipt at manned gates prior to Motor Carrier leaving the Terminal. Motor Carrier will not be held responsible for damages noted on the Equipment Interchange Receipt. If such damage prevents the Motor Carrier from taking the General Purpose Equipment out of the Terminal, the Motor Carrier will notify the CSXIT Terminal manager and/or CSXIT repair contractor that a repair is required. Upon completion of repairs the Motor Carrier will be notified of General Purpose Equipment availability.
