I the undersigned for and on behalf of, and duly authorised by (“the ASSOCIATION”) to sign this Disclaimer and Indemnity, do hereby confirm that the ASSOCIATION purchased from THE NEEMA FOUNDATION (“NEEMA”) certain educational reading programme known as “Gateway into Reading” (“the PROGRAMME”) to be implemented and used by the ASSOCIATION in the development of reading of learners with reading difficulties. I confirm that the ASSOCIATION is independent and has no link legally or otherwise with NEEMA and shall accordingly be responsible for conducting all aspects of the PROGRAMME, including but not limited to, teaching, instruction, administration and general implementation of the PROGRAMME. The ASSOCIATION does hereby indemnify and hold harmless NEEMA, its owners, principals, committee, employees and agents against any loss, injury or damage from whatsoever cause incurred or suffered by the ASSOCIATION and/or its teachers, employees and pupils during the conduct of the PROGRAMME by the ASSOCIATION. The Why Buy Club is only responsible for loss or damage suffered by the “WHY BUY” member or third parties, in connection with the charter of this vessel where such loss or damage was caused intentionally or through gross negligence on its part. In all other cases the Why Buy Club is not responsible. “WHY BUY” members or guests shall hold the Why Buy Club, the Victoria Sailing School, Cherry Creek Marina, Xxxxxxxxx Xxxxxx, State of Colorado, Lake Xxxxxx Xxxxxx, Larimer County, Xxxxxx Xxxxxx, Summit County & Denver Water Board harmless against all such claims. “WHY BUY” member also agrees to hold the Why Buy Club, the Victoria Sailing School, Cherry Creek Marina, Xxxxxxxxx Xxxxxx, State of Colorado, Lake Xxxxxx Xxxxxx, Larimer County, Xxxxxx Xxxxxx, Summit County & Denver Water Board and all their insurance companies harmless from any and all liability whatsoever in connection with scuba diving, snorkeling or any other such activities. The Why Buy Club accepts no responsibility for any allegedly defective condition of the vessel and gives no warranty implied or otherwise with respect to the vessel, related equipment or anything supplied, included but not limited to outboard motor dinghy or fuel.

RCI disclaims all responsibility for the conduct of local emergency response centers and the national emergency calling center. RCI relies upon third parties to assist us in routing 911 Dialing calls to local emergency response centers and to a national emergency calling center. RCI disclaims any and all liability or responsibility in the event such third party data used to route calls is incorrect or yields an erroneous result. RCI disclaims all liability for any VoIP Advantage Service outage and/or inability to dial 911 using your VoIP Advantage Service or to access emergency service personnel due to the 911 dialing characteristics and limitations set forth in this Agreement. You agree to defend, indemnify, and hold harmless RCI, its officers, directors, employees, affiliates and agents and any other service provider who furnishes services to you in connection with VoIP Advantage Service, from any and all claims, losses, damages, fines, penalties, costs and expenses (including, without limitation, reasonable attorneys' fees) by, or on behalf of, you or any third party or user of VoIP Advantage Service relating to the failure or outage of VoIP Advantage Service, including those related to 911 dialing.
