Changes to Fees or Other Terms. We reserve the right to change any term or condition described in this Agreement at any time. If a change would result in increased fees or charges, increased liability for you, fewer types of available electronic funds transfers, or stricter limitation on the frequency or dollar amounts of payments, we will mail to the address shown on our records or deliver to you electronically written notice of such change(s) at least twenty-one (21) days before the effective change(s) in any such terms or conditions, unless prior notice is excused by law or an immediate change is necessary to maintain security of our system. If such an immediate change is made, and it can be disclosed without jeopardizing the security of the system, we will provide you with written or electronic notice no more than thirty (30) days after making the change permanent. If you maintain your Online Services after the effective date of the change, then you are indicating your agreement with accepting the change. Changes to fees applicable to specific loan accounts are governed by the applicable Loan Documents. You agree that we may deliver via electronic communication any future notices and information as may be required by law or regulation to be provided to you pertaining to the Online Services (collectively, "Notices"). We may deliver future Notices electronically by posting such Notices or a link to such Notices on our website or by sending such Notices to the email address that you have provided to us. You agree to promptly notify us of any change in your email address. See Section 10. E-Sign Disclosure and Consent, below.
Changes to Fees or Other Terms. We may change this Agreement at any time by sending notice as described in your Online Banking Agreement; provided, however, that this Agreement governs our right to provide you with that notice electronically. You may choose to accept or decline the change. By continuing to use any Mobile Banking service to which a notice relates, you are deemed to accept the changes relating to that service. Changes to fees applicable to a specific account are also governed by the applicable Account Agreement(s) and any interest or fee schedules pertaining to your account.

By continuing to use the accounts or services to which these changes relate, you are accepting the changes. We reserve the right to change the fees for Online Banking Services, or otherwise modify and amend the Online Banking Services as described in this Agreement, at any time. We will notify you online, or send a notice to you at the address shown on our records, or send you an E‐mail notice, of any changes, modifications or amendments by (a) sending a notice to you at the address shown on our records, (b) sending you an E‐mail notice, or (c) notifying you online by the My Alerts, securing messaging or other electronic message capability within Online Banking Services, which notice shall be deemed given when sent or made available online, regardless of when you retrieve the notice. All notices regarding changes in fees will be provided at least thirty (30) days in advance of the effective date of the change, notices of all other modifications or amendments will be provided at least thirty (30) days in advance, unless an immediate change is necessary to maintain the security of the system. If an immediate change is made, and it cannot be disclosed prior to the change without jeopardizing the security of the system, we will provide you with notice within thirty (30) days after the change. As always, you may choose to accept, or decline the changes. By continuing to use the Online Banking Services to which any notice relates, you are accepting the changes. Changes to fees applicable to specific Eligible Accounts are governed by the applicable Account Agreement(s).

We will send you such notice of those changes as may be required by law or by our other agreements with you. Notice of other changes, if presenting an adverse impact to you or otherwise required by law, will be provided at least twenty-one (21) days in advance of the change’s effective date, unless an immediate change is necessary in our discretion for exigent circumstances (e.g., maintaining the security of the system). If an immediate change cannot be disclosed before it is effective, we will provide any required notice within twenty-one (21) thereafter. By continuing to use the service after a change (or after the effective date of any prior notice), you are accepting the changes. Changes to fees applicable to specific Eligible Accounts are governed by their separate Account Agreements. Features and functionality may be amended without prior notice unless required by law.

Notice that is sent by posting within the Service (e.g., the Website, MyAlerts or Mobile Banking Software) shall be deemed given when posted, regardless of when or whether you retrieve the notice. Notice that is sent to your email address or Mobile Device is deemed given when sent.
