This Order shall not constitute an acceptance of any offer to sell, quotation or other proposal from Supplier, even if referred to in this Order. Acceptance of this Order is expressly limited to the terms of this Order. Buyer hereby notifies Supplier in advance that Buyer objects to any terms and conditions included with Supplier’s quotation, invoice or other document which are additional to or different than the terms of this Order, and none of such additional or different terms shall be part of the contract between Supplier and Buyer, unless specifically accepted by Buyer in a writing signed by an authorized representative of Buyer. This Order shall be irrevocably accepted by Supplier upon the earlier of: (a) Supplier's issuing any acceptance or acknowledgement of this Order; or (b) Supplier's commencement of the work called for by this Order in any manner. The terms set forth in this Order take precedence over any additional or different terms in any other document connected with this transaction unless such additional or different terms are: (i) part of a written agreement signed by both parties, which the parties have expressly agreed may override these terms in the event of a conflict (“Agreement”); or (ii) set forth on the PO to which these terms are attached. In the event these terms are part of an Agreement between the parties, the term “Order” used herein shall mean any purchase order issued under the Agreement.
Acceptance of Terms of Trust Agreement, Guarantee and Indenture. THE RECEIPT AND ACCEPTANCE OF A TRUST SECURITY OR ANY INTEREST THEREIN BY OR ON BEHALF OF A SECURITYHOLDER OR ANY BENEFICIAL OWNER, WITHOUT ANY SIGNATURE OR FURTHER MANIFESTATION OF ASSENT, SHALL CONSTITUTE THE UNCONDITIONAL ACCEPTANCE BY THE SECURITYHOLDER AND ALL OTHERS HAVING A BENEFICIAL INTEREST IN SUCH TRUST SECURITY OF ALL THE TERMS AND PROVISIONS OF THIS TRUST AGREEMENT AND AGREEMENT TO THE SUBORDINATION PROVISIONS AND OTHER TERMS OF THE GUARANTEE AND THE INDENTURE, AND SHALL CONSTITUTE THE AGREEMENT OF THE TRUST, SUCH SECURITYHOLDER AND SUCH OTHERS THAT THE TERMS AND PROVISIONS OF THIS TRUST AGREEMENT SHALL BE BINDING, OPERATIVE AND EFFECTIVE AS BETWEEN THE TRUST AND SUCH SECURITYHOLDER AND SUCH OTHERS.

Acceptance of Terms. Client understands that by accepting an estimate provided by Company, Client agrees to all of the terms and conditions contained in this Contract. Client authorizes Company to accomplish the job specified in the estimate. Client further agrees to hold Company harmless for any property damage not caused by Company’s negligence. Company is not responsible for damages already noted during pre-inspection, when providing an estimate, or during on-site pre-work inspection, including but not limited to, damages to loose siding, paint, wood, trim, windows, oxidation, landscaping, or roofing.

A Product or Service becomes subject to this Agreement when IBM accepts Customer’s order by i) sending Customer a Transaction Document, ii) shipping the Machine or making the Program available to Customer, or iii) providing the Service. IF LICENSEE DOES NOT AGREE TO THIS AGREEMENT, LICENSEE MUST NOT ACCEPT OR DO ANYTHING WHICH WILL CAUSE IT TO BE TAKEN TO HAVE ACCEPTED THIS AGREEMENT. AMENDMENTS TO TERMS. Fuji Xerox may vary these terms (‘Varied Terms’) at any time. Placement of such Varied Terms at xxxx://xxx.xxxx.xxx.xx/product/software/office/SFDC/XXXX/ (or at such other location advised by Fuji Xerox from time to time) is sufficient notice to Licensee of such Varied Terms. Licensee is bound by any Varied Terms from the day they are first made available by Fuji Xerox and it is Licensee’s responsibility to monitor for any Varied Terms.
