Phase II of the Project definition

Phase II of the Project means the development of the next successive 200 MW of energy capacity and accompanying data center(s) associated with the Project, following Phase I of the Project (i.e., 100 MW – 300 MW of the Project) .
Phase II of the Project means activities under the Project scheduled for implementation during the period of approximately 2009-2013, set forth in the Attachment to the Appendix, as said Attachment may be revised from time to time with the mutual agreement of the Recipient and the Association.
Phase II of the Project means the development and construction on the Property of: (i) a hotel with a minimum of 200 rooms with lobby; (ii) a meeting room/event space of not less than 10,000 square feet that is adjacent to the hotel with a capacity of at least 500 guests with sit-down tables or 750 guests in the absence of tables; and (ii) a parking garage with a minimum of 1600 spaces. Tenant intends to make a total investment of not less than $78,000,000 on Phase II of the Project. Phase I and Phase II of the Project are collectively called the “Project”.” A new Exhibit C to the Lease and Development Agreement is substituted entitled “Essential Elements”, which is attached to hereto as Exhibit 1.

Examples of Phase II of the Project in a sentence

  • In the event the District and the Contractor do not establish and agree upon Guaranteed Maximum Price (“GMP”) and Project Schedule for the construction phase of the Project or otherwise elect not to proceed to Phase II of the Project, the Developer or Preconstruction Services Fee (provided in Article 2.1.12) shall constitute the sole financial obligation of District for Phase I services.

  • In the event the District and the Contractor elect not to proceed to Phase II of the Project, the Contractor will be paid a [Developer Fee or Preconstruction Services Fee] of [Insert written dollar amount and $ amount], which shall constitute the sole financial obligation of District for Phase I services.

More Definitions of Phase II of the Project

Phase II of the Project has the meaning given such term in the Recitals. “Phase III of the Project” has the meaning given such term in the Recitals.
Phase II of the Project means (i) the development and construction of a hotel with a minimum of 100 rooms and (ii) some combination of additional hotel rooms, an entertainment/meeting space, additional casino space, additional restaurants, retail space, movie theatres, bowling lanes, or other amenities and additional parking spaces sufficient to serve the aforesaid facilities, as mutually agreed to by Tenant and Landlord, which are intended to increase revenues to the Property. The Tenant shall make an investment of not less than $75,000,000 on Phase II of the Project. The Landlord and the Tenant anticipate that Phase II of the Project may comprise approximately 280,000 square feet but the aggregate square footage will depend on the components selected. Phase I of the Project and Phase II of the Project are collectively referred to as the “Project.” A new Exhibit C to the Agreement is substituted entitled “Essential Elements”, which is attached hereto as Exhibit 1.
Phase II of the Project. Not later than three (3) years following the Commencement Date, Tenant at Tenant’s sole cost and expense, shall complete Phase II of the Project. Tenant shall have the right in Tenant’s discretion to engage any one or more third party developers, retail tenants, contractors, retail consultants, a master retail developer or tenant or other qualified person or corporation to develop, construct and operate all or any portion of Phase II of the Project. In the event Tenant fails to timely perform its obligations with respect to Phase II of the Project, Tenant shall pay to Landlord additional payment or payments in the amounts set forth below on January 2 of each year (or prorated if less than a year), commencing on the January 2 immediately following the expiration of 3 years until such time as Tenant has met its obligations with respect to Phase II or paid a total of $20,000,000 to the Landlord to be used for the benefit of the Xxxxx area, which sums will be collected by Landlord as liquidated damages and not as a penalty and in such event, the Landlord shall not have any other rights or remedies against Tenant with respect to Tenant’s failure to open and operate the Phase II of the Project; provided, however, that if this Lease shall be terminated by Tenant pursuant to the provisions of Section 24 after any such annual payments have been paid or have become due and payable, then Landlord’s recovery of amounts due for failure to open and operate Phase II of the Project, in addition to any payments due under Section 24, shall be limited, effective as of the date this Lease is terminated, to the greater of $12,000,000 or the total amount theretofore paid or due Landlord pursuant to this subsection (i). year one $ 2,000,000 year two $ 3,000,000 year three $ 4,000,000 year four $ 5,000,000 year five $ 6,000,000 ”

Related to Phase II of the Project

  • Scope of the Project shall have the meaning set forth in Clause 2.1;

  • Cost of the Project means and embraces the cost of construction; the cost of all

  • Costs of the Project means Recipient’s actual costs (including any financing costs properly allocable to the Project) that are (a) reasonable, necessary and directly related to the Project, (b) permitted by generally accepted accounting principles to be Costs of the Project, and (c) are eligible or permitted uses of the Financing Proceeds under applicable state or federal statute and rule.

  • The Project Site, where applicable, means the place or places named in the SCC.

  • Redevelopment project means any work or undertaking

  • The Project means supply, installation, testing and commissioning, integration of computer hardware and services with support under Warranty and annual maintenance contract, if required for the contract period.

  • Project means the goods or Services described in the Signature Document or a Work Order of this Contract.

  • Project Completion means completion of the Redevelopment in accordance with this Agreement to the state where the whole of the Morley Shopping Centre, as so redeveloped, is capable of occupation for its intended purpose;

  • Date of commencement of the project means the date of the agreement.

  • Redevelopment Project Area means an area designated by the municipality, which is not less in the aggregate than 1 1/2 acres and in respect to which the municipality has made a finding that there exist conditions which cause the area to be classified as an industrial park conservation area or a blighted area or a conservation area, or a combination of both blighted areas and conservation areas.

  • Construction project means the same as that term is defined in Section 38-1a-102.

  • New Project means (a) each facility which is either a new facility, branch or office or an expansion, relocation, remodeling or substantial modernization of an existing facility, branch or office owned by the Borrower or its Subsidiaries which in fact commences operations and (b) each creation (in one or a series of related transactions) of a business unit to the extent such business unit commences operations or each expansion (in one or a series of related transactions) of business into a new market.

  • Development Project means a project for the development of land within a

  • The Project Plan means the document to be developed by the Supplier and approved by the Purchaser, pursuant to GCC Clause 19, based on the requirements of the Contract and the Preliminary Project Plan included in the Supplier’s bid. The “Agreed and Finalized Project Plan” is the version of the Project Plan approved by the Purchaser, in accordance with GCC Clause 19.2. Should the Project Plan conflict with the Contract in any way, the relevant provisions of the Contract, including any amendments, shall prevail.

  • Project Improvements means site improvements and facilities that are:

  • Project Property means the real property on or for which preconstruction service or construction work is or will be provided.

  • Project Completion Date means the date on which the Completion Certificate is issued;

  • Phase 1 means the first implementation phase of this section, beginning June 1, 2018 and ending May 31, 2022.

  • Redevelopment Area means the community redevelopment area described, defined or otherwise identified or referred to in the Redevelopment Plan.

  • Sub-project means a specific development project to be carried out by a Beneficiary utilizing the proceeds of a Sub-loan; and

  • Ongoing Project means a multi-year project undertaken by a Company in fulfilment of its CSR obligation having timelines not exceeding three years excluding the financial year in which it was commenced, and shall include such project that was initially not approved as a multi-year project but whose duration has been extended beyond one year by the board based on reasonable justification;

  • Phase or “Phases” in respect of the Project shall mean that the components of the Project are placed in service during more than one year during the Investment Period, and the word “Phase” shall therefore refer to the applicable portion of the Project placed in service in a given year during the Investment Period.

  • Expansion Project has the meaning set forth in Section IV.3.a of this Agreement.

  • Capital Improvement Project means the acquisition, construction, reconstruction, improvement, planning and equipping of roads and bridges, appurtenances to roads and bridges to enhance the safety of animal-drawn vehicles, pedestrians, and bicycles, wastewater treatment facilities, water supply systems, solid waste disposal facilities, and storm water and sanitary collection, storage and treatment facilities including real property, interests in real property, facilities, and equipment related or incidental to those facilities.

  • Project site, where applicable, means the place indicated in bidding documents.

  • Project Work means the work required to complete the Project.
