Design Manual definition

Design Manual means the MOHLTC design manual or manuals in effect and applicable to the development, upgrade, retrofit, renovation or redevelopment of the Home or Beds subject to this Agreement.

• Prior to and during construction/erection of the improvement the Building Contractor shall ensure that a copy of the working drawings and plans in respect of the improvements as approved in terms of the Design Manual is on Site and available at all times to the Building Contractor’s employees, as well as being available for inspection by the Developer / HOA during all working hours.

• The Owner acknowledges that he has employed the Building Contractor and the Architect and is responsible to ensure compliance with this Agreement as well as the Design Manual and any rules made in terms thereof from time to time.

• Wherever the provisions of the Design Manual and/or this Agreement are contradictory and/or in conflict with the building contract concluded or to be concluded between the Owner and the Building Contractor for the construction/erection of the improvements, then the provisions of the Design Manual and/or this Agreement (as the case may be) shall prevail.
