Current Stock Price definition

Current Stock Price shall equal the average of the per share closing sale prices of Indevus Common Stock as reported by the Nasdaq Global Market for the 10 trading days ending three trading days prior to the Milestone Date, rounded to the fourth decimal place.
Current Stock Price shall equal the average per share closing sale prices of Menlo Common Stock on the Nasdaq Stock Market as reported by the Wall Street Journal for the five (5) full trading days ending on the fifth (5th) trading date after the later of (i) the Milestone Date or (ii) the Expiration Date.
Current Stock Price means the average of the high and low price of the Common Shares in the Company's trading market over the last 20 trading days prior to the date in question.

Current Stock Price means the closing sale price of such security (or if no closing price is reported, the average of the closing bid and closing ask prices or, if more than one in either case, the average closing bid and average closing ask prices) on such date as reported in composite transactions for the principal United States securities exchange on which the common stock is traded or, if the common stock is not listed on a United States national or regional securities exchange, as reported by the American Stock Exchange. In the absence of such a quotation or listing, the Company will determine the closing sale price by an appraisal by a national appraisal valuation firm. The determination of the fair market value by the appraiser will be conclusive and binding.
Current Stock Price for any day shall mean the last reported sale price, or, in case no such reported sale takes place on such day, the average of the last reported sale prices for the last three trading days, in either case as officially reported by the American Stock Exchange as of 4:00 P.M., New York time.
Current Stock Price means $3.74, which reflects the approximate average of the closing sales prices for the Company’s common stock as quoted on the Nasdaq Stock Market on each day of determination, measured over the 5-day period preceding the Termination Date.

The determination of fair market value by an Independent Appraiser shall be based upon the fair market value of the Issuer determined on a going concern basis as between a willing buyer and a willing seller and taking into account all relevant factors determinative of value, and shall be final and binding on all parties. In determining the fair market value of any shares of Common Stock, no consideration shall be given to any restrictions on transfer of the Common Stock imposed by agreement or by federal or state securities laws, or to the existence or absence of, or any limitations on, voting rights.
