Anti-Social Forces definition

Anti-Social Forces means: o an organized crime group, a member of an organized crime group, a related company or association of an organized crime group, and any other equivalent person of above; or
Anti-Social Forces has the meaning specified in Section 4.01(v).
Anti-Social Forces means persons who fall under any of the following items:

More Definitions of Anti-Social Forces

Anti-Social Forces means one or more persons or entities coming under any of the following items:
Anti-Social Forces means a group or individual which seeks economic benefits by using violence, oppressive power or fraudulent methods, and which falls under following (1) or (2):
Anti-Social Forces means, collectively: (i) criminal syndicate, (ii) criminal syndicate member, (iii) quasi- criminal syndicate member, (iv) criminal syndicate related company, (v) person who poses a threat to the safety of citizens by engaging in illegal activities through violence acts seeking unfair profit against companies and the like, (vi) person who poses a threat to the safety of citizens by disguising or advocating social movements or political activities, (vii) in addition to those listed in the preceding items, group or individual who uses unjust power based on the relationship with criminal syndicate or who have financial connection with criminal syndicate and become a key part of systemic fraud; (viii) person who has ceased to be those listed in the preceding items for a period of less than 5 years; or (ix) other group or individual equivalent to any of the preceding items.
Anti-Social Forces means: (1) an organized crime group, a member of an organized crime group, a related company or association of an organized crime group, and any other equivalent person of above; or (2) a person who themselves or through the use of third parties conducts a demand with violence, an unreasonable demand beyond its legal entitlement, use of intimidating words or actions, damages the credit or obstructs the business of the other party by spreading false rumors or by the use of fraudulent, or any other equivalent actions of above. 2. Each party represents and warrants that is not a person who has fallen and shall not fall under any of the followings: (1) the Anti-Social Forces; (2) a person having such relationship with the Anti-Social Forces that shows the Anti-Social Forces' substantial involvement in the person's management; (3) a person having such relationship with the Anti-Social Forces that shows reliance on the Anti-Social Forces; (4) a person who cooperate and is not involved with the maintenance or operation of any Anti-social Forces by providing funding to any Anti-Social Forces or any similar act; or (5) a person who is engaged in socially condemnable relationship with the Anti-Social Forces. 3. Each party shall be entitled to terminate this Agreement and request for the damages without any notice and any and all obligations of the party owed to the other party shall become due and payable and the other party shall immediately repay such obligations, if the other party breached the representations and warranties in the preceding clause.

Anti-Social Forces means an organized crime group, a corporate racketeer, and any other similar organization. 15. Notices 15.1. Any notice, request, demand or other communication to be given or made under this Agreement shall be deemed to have been delivered, in the case of any notice, request, demand or other communication given or made by letter, posted by registered mail, one (1) business day after the registered delivery date. 16. Liability 16.1. Both parties shall not be liable for losses incurred by one of the parties unless the losses arise from gross negligence, intentional default or fraud on the part of the other party. 16.2. Each party has a duty to forward its best endeavors to limit the extent of the loss caused. If the injured party does not implement adequate measures to limit the extent of the damage, compensation may be reduced. 16.3. Unless otherwise provided by governing law, (a) [Local Good] liability to the Registrant, whether in contract, tort (including negligence or breach of statutory duty) or otherwise, arising out of or in connection with this Agreement shall be limited to (i) 200,000yen per incident, and (ii) a maximum aggregate amount of 600,000yen ; and (b) The Registrant’s liability to [Local Good], whether in contract, tort (including negligence or breach of statutory duty) or otherwise, arising out of or in connection with this Agreement shall be limited to (i) 200,000yen per incident, and (ii) a maximum aggregate amount of 600,000yen. 17. Intellectual Property 17.1. No intellectual property in the I-REC Registry, any I-REC documentation, the I-REC website or [Local Good] website shall (either wholly or partially) be transferred to the Registrant under or pursuant to this Agreement. 17.2. The Registrant holds a non-exclusive, non-transferable licence to use the I-REC Registry, its associated website, and I-REC documentation solely to enable the Registrant to enjoy Issuing Services. 17.3. Neither party shall do or omit to do, or authorise any third party to do, or omit to do, any act which is inconsistent with the rights, ownership or use (as the case may be) of intellectual property of the other part or any third party. 18. Confidentiality 18.1. Information about individuals and organisations held within the I-REC Registry will only be used by [Local Good] to provide the registry services in accordance with the I-REC Code and its Subsidiary Documents. 18.2. Anti-Social Forces means (i) an organized crime group (bouryokudan) (as defined under Article 2, item 1 of the Japanese Act on Prevention of Unjust Acts by Organized Crime Group Members); (ii) a member of an organized crime group (bouryokudan in);(iii) an individual who was a member of an organized crime group within five years; (iv) a quasi-member of an organized crime group (bouryokudan junkoseiin) including individuals who are not members of an organized crime group but who maintain relationships with an organized crime group and who may (x) imply its influence to engage in violent and unlawful activity, or (y) cooperate in the maintenance and operation of an organized crime group; (v) a company (bouryokudan kankei kigyo) or association (bouryokudan kanren gaisha) that is (x) related to an organized crime group, (y) managed by present or former members or quasi-members of an organized crime group, or(z) which actively cooperates with or provides benefits to an organized crime group; (vi) a corporate extortionist and any other advocator of social activism (shakaiundoutou hyoubou goro) or a racketeer or blackmailer (sokaiya) adopting social special intellectual violence group (tokushu chinou bouryoku shudan); or (vii) any Person engaged in activities, or acting in such capacities, that are similar to those listed in the foregoing clauses (i) to (vi) in any jurisdiction;
