Where Western is unable to provide work for employees because of a short-term disruption of work resulting from fire, power failure, shortage of necessary workplace supplies, or other causes beyond its control, Western may layoff employees for no more than four (4) weeks and the provisions of Articles 13 through 16 will not apply.

Where Western. Power has an insured interest or may be entitled to insurance proceeds under any policy listed in Schedule 7, the Service Provider must cause its insurers to waive all rights of subrogation against Western Power in respect of a Claim arising under the insurance policy. Subcontractor insurance If the Service Provider subcontracts any part of the Services, the Service Provider must ensure that every Subcontractor purchases and, for the duration of the subcontract, maintains all the insurance required under clause 13.1.
Where Western. Power is required, under this Contract, to return the whole of a security held as a cash deposit then it will, within a reasonable time, return to the User the unutilised balance of the cash deposit and interest accrued less any charges (including fees and charges associated with maintaining the interest bearing account) and tTaxes attributable to the maintenance of the interest bearing account.
Where Western. Plains Security & Locksmiths considers that any alarm equipment is no longer economically serviceable (due for example to age, obsolescence or unavailability of spare parts) then Western Plains Security & Locksmiths may elect to cease to provide maintenance of that equipment, or any part of it. Western Plains Security & Locksmiths will give the Customer one month’s notice of its intention to cease to provide maintenance and will adjust the maintenance fees payable by the Customer to reflect the reduction in maintenance services provided. Unless the parties otherwise agree, a reduction in maintenance service under this clause 4.4 will not affect the remainder of this agreement, which will continue in full force and effect.
Where Western. Power cannot use an AMI Meter due to a Metering Point arrangement that is inconsistent with the WA Distribution Connections Manual, Western Power will use a Non-AMI Meter to provide this Service. This Service description should be read in conjunction with the Code and the Communication Rules, which incorporate the Build Pack. The Build Pack, including the WA B2B Procedures: Service Order Process, defines specific detail as to the business processes and B2B transactions associated with the provision of this Service. Eligibility Criteria:  An Additions & Alterations – Exchange Meter Service Order in accordance with the Communication Rules.  This Service cannot be used to replace an AMI Meter with a Non-AMI Meter.
Where Western. Victoria PHN provides it consent under clause 19.1, the terms of this Agreement will be implied into any subcontract and Western Victoria PHN can impose any additional conditions it considers appropriate when giving its consent.
Where Western. Power changes the Service applicable to a Connection Point for a Small Customer then the User may not, unless Western Power agrees otherwise, request that the Connection Point revert to the prior Service applicable to the Small Customer at that Connection Point.
