Wages of Employees. This Contract is subject to the minimum wage requirements of Chapter 39.12 of the Revised Code of Washington, as now existing or hereafter amended or supplemented. In the payment of hourly wages and fringe benefits to be paid to any of Contractor's laborers, work persons and/or mechanics, Contractor shall not pay less than the "prevailing rate of wage" for an hour's work in the same trade or occupation in the locality within the State of Washington where such labor is performed, as determined by the Industrial Statistician of the Department of Labor and Industries of the State of Washington. Prevailing wages paid pursuant to this Agreement shall be the prevailing wage rates which are in effect on the date when the bids, proposals, or quotes were required to be submitted to the City. The State of Washington prevailing wage rates applicable for this public works project, which is located in King County, may be found at the following website address of the Department of Labor and Industries: xxxxx://xxx.xx.xxx/licensing‐permits/public‐works‐projects/prevailing‐wage‐ rates/. A copy of the applicable prevailing wage rates is also available for viewing at the office of the City located at 0000 XX 00xx Xx, Xxxxxx Xxxxxx, XX 00000. Upon request, the City will mail a hard copy of the applicable prevailing wages for this project.

In the payment of hourly wages and fringe benefits to be paid to any of Contractor's laborers, workpersons and/or mechanics, Contractor shall not pay less than the "prevailing rate of wage" for an hour's work in the same trade or occupation in the locality within the State of Washington where such labor is performed, as determined by the Industrial Statistician of the Department of Labor and Industries of the State of Washington, which "prevailing rates of wage" are attached hereto as Exhibit "H" and incorporated herein by this reference. Prevailing wages paid pursuant to this Agreement shall be the prevailing wage rates, which are in effect on the date when the bids, proposals, or quotes were required to be submitted to the City.
Wages of Employees. The Contractor shall provide a copy of its certified payroll for the project with each invoice to District Engineer. The District may investigate any discrepancies in actual payments to those required by the general prevailing rates determined by the State Director of the Department of Public Relations for the locality in which the work is performed. The time of service of any worker shall be restricted to eight (8) hours during any calendar day and forty (40) hours during a calendar week unless overtime compensation is paid at not less than one and one-half times the basic rate of pay. The Contractor shall forfeit, as penalty, to the District, twenty-five dollars ($25) for each worker employed in execution of the contract by Contractor or by any subcontractor, for each calendar day during which any worker is required or permitted to labor more than eight (8) hours in any one (1) calendar day and forty (40) hours in any one (1) calendar week in violation of the provisions of Section 1775, Labor Code. The Contractor shall comply with Section 1776, Labor Code, by maintaining accurate and complete payroll records and making such records available for inspection. Subcontractors shall also comply with the Section 1776 provisions, but the prime responsibility for maintenance and availability of complete and accurate payroll records rests with Contractor.
