STATEMENT OF THE FACTS. Xxxxxx X. Xxxxxxx was employed as an assistant football coach by the Bremerton School District at Bremerton High School from 2008 until 2015. Xxxxxxx v. Bremerton Sch. Dist., 869 F.3d 813, 5 (9th Cir. 2017). During his employment, Xxxxxxx worked under contracts that were one year in length. The contract stated that “that BSD ‘entrusted’ Xxxxxxx ‘to be a coach, mentor and role model for the student athletes.’ Xxxxxxx further agreed to ‘exhibit sportsmanlike conduct at all times,’ and acknowledged that, as a football coach, he was ‘constantly being observed by others.’” Id. Xxxxxxx is a man of Christian faith and would lead student athletes as well as other coaches in prayer in the locker room before games. Id. Xxxxxxx would also pray at the middle of the field after games, dating back to when he first got hired. Id at 6. He would do so while still in BHS apparel. Id. Xxxxxxx initially started doing these post game prayers by himself, but they evolved in to group prayers, and then evolved to a point where they were accompanied by speeches and players raising their helmet while Xxxxxxx led the prayers. Id. The School District was informed of Xxxxxxx’x prayers in September of 2015. Id at 7. The District has a “Religious-Related Activities and Practices” policy that states: “[s]chool staff shall neither encourage nor discourage a student from engaging in non-disruptive oral or silent prayer or any other form of devotional activity.” Id. Xxxxx Xxxxxxx , Super Intendent of the School district, sent a letter to Xxxxxxx explaining that his prayers were “problematic” but also explained that Xxxxxxx could continue his motivational talks, as long they were nonreligious. Id at 7-8. Xxxxxxx also stated in his September letter to Xxxxxxx that he was welcome to engage in religious activity as long as it was kept separate from student activities and it did not interfere with his work. Id at 8. Xxxxxxx complied with Xxxxxxx’x letter for a couple of weeks until October 14, 2015, on which he sent the School District a letter that requested he be allowed to continue his prayers under the Civil Rights Act of 1964. Xxxxxxx argued that his post game prayers occurred after his coaching duties had ended, because his responsibilities ended when the game ended. He argued that his prayers did not exclude anyone because they did not reference a specific religion.   • Statement of Services Service Attachments The services to be delivered by Provider (the “Services”) and the fees for those Services, and the specific terms applicable to those Services are described in the Order or in one or more Service Attachments referencing this Agreement. Except for Supplemental Services or Project Services (described below), and unless otherwise agreed in writing, the services we will deliver to you are limited to those Services specifically identified in the Order and described in the Service Attachments. Examples of such services include major system upgrades, new computer, machine or device setup, network changes, datacenter moves or setups, or installations. In those cases, we will prepare a separate Service Attachment for Project Services describing the proposed scope of those services and our fee to deliver them. Installation dates are estimates only. Customer shall be responsible for preparation and maintenance of the site for such Project Services or installations, including, but not limited to, providing necessary electrical power and communication lines and proper air conditioning and humidity control. FEES FOR SERVICES | PAYMENT TERMS Service Fees Fees for Services are set forth in Order or Statement of Work. Unless otherwise indicated in writing, all Services will be performed on a time-and-materials basis at Provider’s then-current rates.

  • Accidents and Dangerous Occurrences The Hirer must report all accidents involving injury to the public to a member of the Village Hall management committee as soon as possible and complete the relevant section in the Village Hall’s accident book. Any failure of equipment belonging to the Village Hall or brought in by the Hirer must also be reported as soon as possible. Certain types of accident or injury must be reported on a special form to the local authority. The Hall Secretary will give assistance in completing this form. This is in accordance with the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 (RIDDOR).

  • Events If either Party hereto is at any time either during this Agreement or thereafter prevented or delayed in complying with any provisions of this Agreement by reason of strikes, walk-outs, labour shortages, power shortages, fires, wars, acts of God, earthquakes, storms, floods, explosions, accidents, protests or demonstrations by environmental lobbyists or native rights groups, delays in transportation, breakdown of machinery, inability to obtain necessary materials in the open market, unavailability of equipment, governmental regulations restricting normal operations, shipping delays or any other reason or reasons beyond the control of that Party, then the time limited for the performance by that Party of its respective obligations hereunder shall be extended by a period of time equal in length to the period of each such prevention or delay.
