Shipment of Product to ORPHAN - Only approved, finished (unless required by ORPHAN), labeled PRODUCTS will be shipped by C*P to ORPHAN. Any shipment of product from C*P which is Unapproved or under Quarantine requires prior written consent by the ORPHAN’S Quality Unit. This authorization will be on a lot by lot basis.
Shipment of Product. 4.1 Subject to delay due to force majeure, Manufacturer will ship Product on the date indicated in Distributor's purchase order if such order is within the then current sales projection of Distributor. If such order is beyond the projection, Manufacturer will use commercially reasonable efforts to meet such order and will not unreasonably withhold or delay its acceptance of the order.
Shipment of Product. EDT shall ship, or cause to be shipped, at SM’s expense, the Product to SM or such destination(s) as SM may designate in writing. Product will be shipped FOB SM’s designated delivery location, and all risk of loss or damage therein shall pass to SM when each such order of the Product is delivered to SM’s designated facility. Title to the Product supplied to SM by EDT pursuant to an applicable purchase order shall remain in EDT until delivery to the SM’s designated facility, at which time title shall pass to the SM and SM shall assume all risk of loss or damage. All invoices and other shipping documents shall be sent via first class mail or by fax to SM’s address for notices under this Agreement.
Shipment of Product. 7.2.1 NECCSD will ship all PRODUCT ordered to a single ship-to-point within the U.S.A. provided by RESELLER. RESELLER may, upon thirty (30) days prior written notice to NECCSD, modify this single ship-to-point.
Shipment of Product. Pharmacy shall label all product on a patient specific manner and ship product directly to provider, at the DEA address denoted by provider on the Order Form, who will be administering the product. Tracking of product from pharmacy to implant location will be monitored.
Shipment of Product. Delivery from JIT Hubs will be made DDU (i.e., the ICC standard shipping term for delivery duty unpaid), and liability for loss or damage to Products will pass to WDC upon Komag’s delivery of the Products to WDC. Delivery from Komag factory will be made EXW-Komag factory (i.e., the ICC standard shipping term for Ex Works), unless the delivery is late in which case the delivery will be made DDU. As between the parties, Komag will bear the cost for insurance relating to delivery of the Products. For deliveries within Malaysia or Thailand, Western Digital Malaysia SDN. BHD, or Western Digital (Thailand), respectively, will be the “importer of record” for GST purposes. Komag may deliver the Products in installments subject to Section 5.2. Unless otherwise agreed, all Products will be packaged and packed in accordance with Komag’s normal practices. All Product packages shall be labeled in accordance with applicable customs regulations. Komag may ship, determine freight forwarder, and provide delivery support by the method it deems most advantageous. WDC shall ensure that the freight forwarder selected by Komag may use WDC’s “Manufacturer’s Export Status” for shipments on behalf of WDC to Thailand, so long as the parties mutually agree. Transportation charges are included in the Unit Price. Komag shall deliver, upon request from WDC, appropriate import certificates for duties paid on Media purchased from Komag, imported by Komag into the United States and delivered to WDC in the United States.

Shipment of Product. INNOCOLL shall deliver the Product, ***. The parties will cooperate to obtain the best commercial rates for shipping costs. BIOMET shall arrange for shipping in compliance with the applicable Product requirements regarding temperature, duration and other environmental factors as required to properly preserve the Product without materially impacting its shelf life. All Product delivered by INNOCOLL shall be suitably packed and marked for shipment to such BIOMET location as BIOMET may designate. INNOCOLL shall ship all Product in accordance with the instructions specified in BIOMET’s purchase orders. A Certificate of Analysis (“COA”), specific to testing of each lot/batch, must accompany each shipment. INNOCOLL shall maintain a copy of each such COA in compliance with cGMP/QSR. INNOCOLL shall provide a duplicate copy of the COA to BIOMET, upon BIOMET’s request.
Shipment of Product. Shipment of Product will be to the distribution center(s) designated by Celsion in China. Hisun will not make direct shipments to final customers. Celsion will select and pay the carrier to be used. Product will be shipped, per Specification, FOB Shanghai, China, freight class, Class 70 (Class of Commodity for Food and Pharmaceutical Product), or as may otherwise be required pursuant to Applicable Laws and Product storage specifications. All Product shipped by Hisun shall be clearly marked for delivery to the Celsion or customer locations as Celsion may designate. Hisun shall ship all Product in accordance with the instructions specified in Celsion’s purchase order. A Certificate of Analysis (“COA”), a form of which is attached hereto as Schedule 4.4, specific to the testing of each lot/batch, must accompany each shipment. Hisun shall maintain a copy of each such COA in compliance with GMP. Hisun shall provide a duplicate copy of the COA, a commercial invoice and an airway xxxx with each shipment. Title and risk of loss or damage to the Product will remain with Hisun until it reaches the distribution center designated by Celsion in Shanghai, China, at which time title to the Product will rest in, and risk of loss or damage to the Product will pass to, Celsion FOB Shanghai, China.
Shipment of Product. 5.1 Unless Del Monte and Supplier mutually agree in writing upon a different procedure, the Product shall be supplied on a delivered basis, duty unpaid, to Del Monte's distribution center in McAllen, Texas, or other such facility as mutually agreed upon by both parties, pursuant to shipping orders submitted by Del Monte. Del Monte shall generally allow at least seven (7) days from the date it issues a shipping order to the delivery date(s) specified in such order. Del Monte shall have the right to reschedule any Product delivery date provided it gives Supplier notice of such rescheduled delivery date at least forty eight (48) hours prior to the previously scheduled delivery date and further provided that such rescheduled delivery date is at least forty eight (48) hours after the date of such rescheduling notice. On a weekly basis, Supplier shall notify Del Monte, via telefax, of the quantity of Product produced and the quantity of Product shipped by Supplier each day during such period. The parties agree that time is of the essence with respect to dates of delivery hereunder.
