Selected Option Pursuant to Article 5. 1 Developer has selected the Standard Option pursuant to Article 5.1 The following milestones shall apply to the engineering, procurement, construction, and testing for the interconnection of the Merchant Transmission Facility, DAF and SUFs. The actual dates for completion of the milestones are highly dependent upon lead times for the procurement of equipment and material, the availability of labor, outage scheduling, receipt of regulatory approvals, and the results of equipment testing. The completion and results of environmental remediation of the site, and other unforeseen events could also affect the achievement of the milestones. The Connecting Transmission Owner is under no obligation to undertake any engineering, procurement, or construction work pursuant to this Agreement, until the requirements of Appendix H, section 2 are satisfied, except as specified in Appendix H, section 1(d).
Selected Option Pursuant to Article 5. 1 Under Section 5.1 of this Agreement, Developer and Connecting Transmission Owner have agreed that, pursuant to Subsection 5.1.3 (Option to Build), Developer will design, procure and construct the Connecting Transmission Owner’s Attachment Facilities and Stand Alone System Upgrade Facilities identified in Sections 1.b and 2.a of Appendix A of this Agreement. Developer will be responsible for the design and procurement, and Con Edison for the construction and installation, of the System Upgrade Facilities identified in Section
Selected Option Pursuant to Article 5. 1 Under Section 5.1 of this Agreement, Developer and Connecting Transmission Owner have agreed that, pursuant to Subsection 5.1.3 (Option to Build), Developer will design, procure and construct the Connecting Transmission Owner’s Attachment Facilities and Stand Alone System Upgrade Facilities identified in Sections 1.b and 2.a of Appendix A of this Agreement. Developer will be responsible for the design and procurement, and Con Edison for the construction and installation, of the System Upgrade Facilities identified in Section 2.b of Appendix A of this Agreement. The Developer shall transfer and the Connecting Transmission Owner shall accept operational responsibility for the Connecting Transmission Owner’s Attachment Facilities and Stand Alone System Upgrade Facilities on the Operational Transfer Date, provided that the Developer (i) shall prior to the Operational Transfer Date, or in a timeframe otherwise acceptable to the Connecting Transmission Owner, provide the Connecting Transmission Owner with any documentation as reasonably required and requested by the Connecting Transmission Owner to comply with any applicable NERC requirements and standards and (ii) shall have constructed that portion of the Connecting Transmission Owner’s Attachment Facilities and Stand Alone System Upgrade Facilities required for initial Back Feed, in accordance with the requirements set forth in the Connecting Transmission Owner approved construction work packages. The Developer shall transfer and the Connecting Transmission Owner shall accept transfer of ownership of the Connecting Transmission Owner’s Attachment Facilities and Stand Alone System Upgrade Facilities on or before the Ownership Transfer Date, provided that the Developer shall have constructed the Connecting Transmission Owner’s Attachment Facilities and Stand Alone System Upgrade Facilities in accordance with the requirements set forth in the Connecting Transmission Owner approved construction work packages.
Selected Option Pursuant to Article 5. 1 Under Article 5.1 of this LGIA, Developer and Transmission Owner have selected the Option to Build, except for Transmission Owner’s activities described in Sections 1(b)(ii) and 2(b) of Appendix A which shall be performed in accordance with the Standard Option. Further, the Parties have agreed to the division of responsibilities and scope as detailed in Appendix A, Sections 1 and 2.
Selected Option Pursuant to Article 5. 1 The selected option under Article 5.1 of this Interconnection Agreement is the “Option to Build” except for Transmission Owner’s engineering, procurement and construction obligations which shall be performed in accordance with the “Standard Option.” The Parties have agreed to the division of responsibility and scope as described in Section III of Appendix A.
Selected Option Pursuant to Article 5. 1 Pursuant to Article 5.1.1 of this Agreement, the CTO shall design, procure, and construct the CTO Attachment Facilities.
Selected Option Pursuant to Article 5. 1 Pursuant to the Standard Option in Article 5.1.1, Developer and Connecting Transmission Owner have mutually agreed to the dates set forth in the milestone schedule below for completion of the Connecting Transmission Owner’s Attachment Facilities.
