Construction and Installation. In the event PSINet desires to connect any of its POPs to any IXC POP, PSINet may construct, install, operate and maintain a connection facility (the "POP-to-POP Interconnect Facility") between the PSINet premises and the IXC Premises so long as PSINet meets or exceeds the standards set forth in Section 7.2. PSINet shall provide at its expense all necessary rights-of-way, permits, equipment and IXC-approved materials to construct and install each POP-to-POP Interconnect Facility, including, but not limited to, cables and conduit and any labor charges associated therewith. If necessary, and where applicable, IXC shall use commercially reasonable efforts to provide PSINet, at PSINet's expense, access to existing building entrance facilities, if available, to access and exit IXC POPs. The demarcation point for PSINet shall be in the IXC POPs at the Connect Panel or the DSX panel, as appropriate.

Construction and Installation. The Developer, at its sole cost and expense, shall construct and install the Water and Sewage Facilities in accordance with the approved Plans and Specifications.
Construction and Installation. (a) After receipt of an initial franchise, a Grantee shall proceed with due diligence to install and begin operation of the franchise.
Construction and Installation. The Developer will construct and install each Building System in accordance with the Design Guide and with the final Thermal Energy delivery parameters agreed and approved pursuant to Section 3.1. The Developer will keep Corix reasonably informed regarding the progress of construction and installation of each Building System. Without limiting the generality of the foregoing, the Developer will provide at least 90 days’ written notice to Corix of the Developer’s scheduled target date (the “Target Date”) by which: (a) the Developer will have completed the construction and installation of each Building System in accordance with this Section 3.2; (b) the Developer will have each Building System ready for connection to the Energy Transfer Station in accordance with Section 3.3; and (c) each Building will be ready to receive Energy Services from Corix.

In connection therewith, Licensee has the right to do all work necessary to prepare, add, maintain and alter the Premises for Licensee’s communications operations and to install utility lines and transmission lines connecting antennas to transmitters and receivers; provided, however, that such construction, installation, operation, maintenance, repair, replacement, or removal is done in accordance with this Agreement, the Plans and Specifications, the Final Specs including any amendments approved by the Village, and all applicable federal, state and local laws, statutes, regulations and ordinances.
Construction and Installation. Subject to other provisions of this Contract, ESCO will act as a turn-key general contractor assuming total responsibility for all phases of construction and installation, including but no limited to: (a) selecting Subcontractors in concert with the City; (b) awarding Subcontracts in accordance with Exhibit IV (Economic Opportunity Plan) as approved by the City and set forth in Schedule O (City Approved Subcontractor List) and notifying the City in writing of any changes in subcontractors prior to their selection and subcontract awards; (c) preparing and submitting all Design and Engineering Documents for approval by the PEA’s Project Manager in accordance with Paragraph 7.2.2 (Design and Engineering Approval); (d) obtaining all necessary permits, licenses and approvals and coordination during installation in accordance with the provisions of Articles 10 (Coordination and Construction Requirements) and 33 (Compliance with Applicable Laws); (e) purchasing of Equipment, software and materials for the Selected ECMs; (f) installation and start-up of the Equipment, software and materials for the Selected ECMs; (g) progress inspections during installation; (h) developing and presenting subcontractor punch lists after each inspection; (i) receiving and evaluating record drawings and operation and maintenance manuals from Subcontractors; (i) training of staff and service providers on proper operation and service of the newly installed Selected ECMs in accordance with the provisions of Article 9 (Training by ESCO); and (k) final inspection and recommendation for approval by the PEA and City.

Without limiting the generality of the foregoing, the Developer will provide at least 270 days’ written notice to Corix of the Developer’s scheduled target date (the “Scheduled Target Date”) as part of the Final Thermal Energy Delivery Parameters agreed to by the Parties, by which date: (a) the Developer will have completed the construction and installation of each Building System in accordance with this Section 3.2; (b) the Developer will have each Building System ready for connection to the Energy Transfer Station in accordance with Section 3.3; and (c) each Building will be ready to receive Energy Services from Corix.

Xxxxxxxx shall reasonably cooperate with WinStar to facilitate reasonable WinStar requests for Interconnection Facilities. Specifically, if necessary, and where applicable, Xxxxxxxx shall assist WinStar at WinStar's expense, in obtaining from any third-party building owner or Xxxxxxxx lessor access to existing building entrance facilities, if available, to access and exit Transmission Sites. The demarcation point for WinStar's facilities shall be in Xxxxxxxx' fiber patch panel or the DSX-N panel in the Transmission Sites, as appropriate.
