Appendix D Security Arrangements Details Infrastructure security of New York State Transmission System equipment and operations and control hardware and software is essential to ensure day-to-day New York State Transmission System reliability and operational security. The Commission will expect the NYISO, all Transmission Owners, all Developers and all other Market Participants to comply with the recommendations offered by the President’s Critical Infrastructure Protection Board and, eventually, best practice recommendations from the electric reliability authority. All public utilities will be expected to meet basic standards for system infrastructure and operational security, including physical, operational, and cyber-security practices. All personnel working in Transmission Owner’s facilities will require security background checks prior to entering and working in such facilities. Developer Operating Requirements. (a) Developer shall comply with all provisions of NYISO tariffs and procedures, as amended from time to time, which apply to any aspect of the Merchant Transmission Facility’s operations and its participation in NYISO-administered markets. Tariff revisions and/or operating protocols with NYISO, PJM, the Connecting Transmission Owner, and Developer may need to be developed to incorporate the Merchant Transmission Facility into NYISO-administered markets and to coordinate the operational control of the facility.

If the Attachment Facilities, System Upgrade Facilities, or other upgrades for the Large Generating Facility identified in the Class Year 2010 Interconnection Facilities Study differ in any material way from the facilities identified in the Appendices to this Agreement, the Parties shall amend this Agreement, pursuant to its sections 29.11 and 29.12, to reflect the Attachment Facilities, System Upgrade Facilities, or other upgrades identified in the Class Year 2010 Facilities Study. The Developer shall accept the cost allocated to the Large Generating Facility for SUFs through the Class Year 2010 Interconnection Facilities Study and post any associated security and make any payment required, pursuant to Attachment S of the NYISO OATT. The Large Generating Facility may commence Trial and Commercial Operation prior to the final settlement of the Class Year 2010 Interconnection Facilities Study; and pursuant to this Agreement Developer agrees to accept its cost allocation from the Class Year 2010 Interconnection Facilities Study and post any required security or make any required payment upon final settlement of Class Year 2010. The Developer may not supply Unforced Capacity to the NYCA from the Large Generating Facility until the Developer has complied with the deliverability requirement pursuant to Attachment S of the NYISO OATT, including acceptance of any cost allocated to the Large Generating Facility for SDUs through the Class Year 2010 Interconnection Facilities Study and the posting of associated security or payments.

The NYISO may direct the operation of substation equipment, including breaker status, within the Cricket Valley Substation, as needed to address reliability concerns impacting the NYCA.

Developer must comply with Connecting Transmission Owner’s operating instructions and requirements which are set forth below. • This document describes the operating requirements between Con Edison’s System Operation Department and Xxxxxx Xxxxx Generation Plant (the “Plant”) connected to the Con Edison electrical system at Goethals 345KV Substation as illustrated on Goethals 60 cycles operating diagram 70. • Operating one-line diagram 9C shows the operating jurisdictional boundaries of Con Edison’s System Operation Department. • The Con Edison District Operator (“District Operator”) or Con Edison System Operator (“System Operator”) shall direct all operations on equipment within Con Edison’s jurisdictional boundaries in accordance with System Operation’s Department Procedures/Con Edison specifications and the Con Edison General Instructions Governing Work on System Electrical Equipment (the “Rulebook”). • Con Edison’s District Operator and System Operator each shall have a dedicated direct line (two direct lines in total from the ECC) to the Control Room Operator and if such direct line is not available for any reason, the Control Room Operator can be reached via outside telephone line at 000-000-0000 or 000-000-0000 or such other telephone line as the Plant shall provide. The Plant shall notify the District Operator of any change in their control room outside telephone number. • Additional System Operation procedures and policies govern the operating relationship between Con Edison and Xxxxxx Xxxxx includes, but is not limited to Rulebook, and System Operation Department’s Procedures. • In order to not exceed the nominal designed capacity of the Goethals Substation equipment in the case of a trip out of Con Edison feeders exiting Goethals Substation, the Plant shall reduce its MW output upon notification from the Con Edison District Operator or Con Edison System Operator. • Xxxxxx Xxxxx will operate the Plant and provide advance notification to the Con Edison Chief District Operator in the event that the Plant changes ownership or will be operated by a different entity. • The Plant shall respond to emergencies as directed by the Con Edison System Operator, and/or Con Edison District Operator. • The Plant shall provide to the Con Edison Chief System Operator, the generator’s MVAR capability curves and the Generator Step Up transformer’s No Load Tap Changer...
Developer Operating Requirements. Developer must comply with Connecting Transmission Owner’s operating instructions and requirements as set out in the most current version of National Grid’s Electric System Bulletin 756 and all applicable NYISO tariffs and procedures, as amended from time to time. In the event Developer installs additions, modifications or replacements to the Generating Facility such that output of the facility exceeds the maximum capacity stated above, then Developer agrees to comply with all applicable requirements of the NYISO interconnection process related to such an increase in capacity and to operate said additions, modifications or replacements to in conformance with Niagara Mohawk’s Electric System Bulletin No.756 in effect at the time such additions, modifications or replacements is installed. Nothing in this Section II shall limit the obligation of Developer to operate the Generating Facility and the Developer’s Attachment Facilities in accordance with Applicable Reliability Standards and any applicable NYISO requirements, and Developer shall take all appropriate steps to remain in compliance with Applicable Reliability Standards and any applicable NYISO requirements.

With respect to Capacity Resource Interconnection Service (“XXXX”), the Large Generating Facility has a XXXX value as of the Effective Date of 94.4 MW. The Large Generating Facility’s XXXX value will be limited to 94.4 MW, unless it is subsequently increased pursuant to an applicable provision of the NYISO OATT.
