Developer Operating Requirements. The Developer must comply with the Transmission Owner’s operating instructions and requirements including but not limited to Transmission Owner’s Operation Coordination Agreement, as it may change from time to time. The Developer must comply with all applicable NYISO tariffs and procedures, as amended from time to time. Whether or not the Large Generating Facility is eligible for the Transition Period LVRT Standard set forth in Appendix G will be determined by the Commission. The Large Generating Facility will comply with the Transition Period LVRT Standard pending issuance of an order by the Commission determining the appropriate LVRT standard. For purposes of compliance with Appendix G, the Transmission Owner has determined that the Developer shall maintain the Large Generating Facility in service during a three-phase fault for 7 cycles. Appendix D Security Arrangements Details Infrastructure security of New York State Transmission System equipment and operations and control hardware and software is essential to ensure day-to-day New York State Transmission System reliability and operational security. The Commission will expect the NYISO, all Transmission Owners, all Developers and all other Market Participants to comply with the recommendations offered by the President’s Critical Infrastructure Protection Board and, eventually, best practice recommendations from the electric reliability authority. All public utilities will be expected to meet basic standards for system infrastructure and operational security, including physical, operational, and cyber-security practices. All personnel working in Transmission Owner’s facilities will require security background checks prior to entering and working in such facilities. Developer Operating Requirements. (a) Developer shall comply with all provisions of NYISO tariffs and procedures, as amended from time to time, which apply to any aspect of the Merchant Transmission Facility’s operations and its participation in NYISO-administered markets. Tariff revisions and/or operating protocols with NYISO, PJM, the Connecting Transmission Owner, and Developer may need to be developed to incorporate the Merchant Transmission Facility into NYISO-administered markets and to coordinate the operational control of the facility.

The Developer shall accept the cost allocated to the Large Generating Facility for SUFs through the Class Year 2010 Interconnection Facilities Study and post any associated security and make any payment required, pursuant to Attachment S of the NYISO OATT. The Large Generating Facility may commence Trial and Commercial Operation prior to the final settlement of the Class Year 2010 Interconnection Facilities Study; and pursuant to this Agreement Developer agrees to accept its cost allocation from the Class Year 2010 Interconnection Facilities Study and post any required security or make any required payment upon final settlement of Class Year 2010. The Developer may not supply Unforced Capacity to the NYCA from the Large Generating Facility until the Developer has complied with the deliverability requirement pursuant to Attachment S of the NYISO OATT, including acceptance of any cost allocated to the Large Generating Facility for SDUs through the Class Year 2010 Interconnection Facilities Study and the posting of associated security or payments.

Developer Operating Requirements. Developer must comply with Connecting Transmission Owner’s operating instructions and requirements as set out in the most current version of National Grid’s Electric System Bulletin 756 and all applicable NYISO tariffs and procedures, as amended from time to time. In the event Developer installs additions, modifications or replacements to the Generating Facility such that output of the facility exceeds the maximum capacity stated above, then Developer agrees to comply with all applicable requirements of the NYISO interconnection process related to such an increase in capacity and to operate said additions, modifications or replacements to in conformance with Niagara Mohawk’s Electric System Bulletin No.756 in effect at the time such additions, modifications or replacements is installed. Nothing in this Section II shall limit the obligation of Developer to operate the Generating Facility and the Developer’s Attachment Facilities in accordance with Applicable Reliability Standards and any applicable NYISO requirements, and Developer shall take all appropriate steps to remain in compliance with Applicable Reliability Standards and any applicable NYISO requirements.
