QUALIFICATIONS OF CONTRACTOR. The Commonwealth may make such reasonable investigations as deemed proper and necessary to determine the ability of the Contractor to perform the services/furnish the goods. The Commonwealth reserves the right to inspect, without advance notice, Contractor’s physical facilities at any time during the initial term and any subsequent renewal periods, to satisfy questions regarding the Contractor’s capabilities.

QUALIFICATIONS OF CONTRACTOR. Proposals will be considered only from firms normally engaged in providing the types of services specified herein. CCPRC reserves the right to inspect the facilities, equipment, personnel and organization or to take any other action necessary to determine ability to perform in accordance with specifications, terms and conditions. CCPRC will determine whether the evidence of ability to perform is satisfactory and reserves the right to reject proposals where evidence or evaluation is determined to indicate inability to perform.
QUALIFICATIONS OF CONTRACTOR. The Contractor specifically represents that he and his members, officers, employees, agents, servants, consultants and subcontractors have the experience, knowledge and character necessary to perform their particular duties under this Agreement.
QUALIFICATIONS OF CONTRACTOR. Contractor must maintain a business establishment with access to adequate inventories of complete product lines for their awarded lot(s) as identified and contained in all product categories listed herein, and must be capable of processing and shipping large numbers of consolidated orders to various destinations. Contractor must be able to service all delivery locations in a Region in a timely and efficient manner and in accordance with the requirements of this Contract. Contractor is responsible for administering contract, resolving problems, etc., for all participating branches/warehouses/distribution centers, etc. Contractor shall maintain all required contract-specific insurance in this Contract and APPENDIX C – FOOD (Commercial: Downstate Region) DOCUMENTS, Number 6 Insurance Requirements. Contractor shall meet the reporting requirements in SECTION 49 ADMINISTRATIVE AND REPORTING REQUIREMENTS. OGS’s interpretation of specifications shall be final and binding upon the Contractor.

Consultant further assures the College that Consultant is free from any financial interests which may conflict with the prior performance of this Agreement. Consultant covenants that he shall not acquire any interest, direct or indirect, financial or otherwise, that would conflict in any manner or degree with the performance of services under this Agreement. Consultant certifies that no one who has or will have any financial interest under this Agreement is an official or employee of the College.

QUALIFICATIONS OF CONTRACTOR. Each Contractor shall be reliable, responsible, fully able to perform its portion of the Work covered, and able to complete the Work in accordance with this Agreement. Each Contractor shall be duly licensed by the State of California as applicable. Developer may not use unqualified, inexperienced or non-responsive Contractors. Contractors shall not have been terminated for default on any project within the previous three years, shall never have submitted a false claim to any Governmental Entity, and shall not be suspended or debarred from contracting with any Governmental Entity in accord with Section 21.10, “Debarment and Suspension.”
