Particular Duties. The Ombudsman will investigate all allegations of violations of this Agreement, Government contract laws, rules, and regulations, or other matters that raise questions concerning EGL’s present responsibility. The Ombudsman will also be provided with the services of an interpreter, if the allegations are made in a language other than English. For this purpose, the Ombudsman, shall have at the conclusion of each investigation, and provide a written report to EGL’s President, Board of Directors and the Army, detailing the substance of the allegations, evidence revealed by the investigation, and the findings and recommendations. EGL shall take corrective action where appropriate. The Ombudsman’s complete investigative file shall be furnished to the Army. This provision does not preclude participation in the Department of Defense Voluntary Disclosure Program.

Particular Duties. Hydro USA shall require the Independent Monitor to review Hydro USA’s Annual Reports required under this Agreement and certify whether or not Respondents have complied with the terms of this Agreement during the reporting period. Hydro USA shall provide the Independent Monitor with the same access to materials and Employees as Hydro USA provides the EPA Authorized Representative pursuant to “V.7” of this Agreement. Hydro USA shall require the Independent Monitor to provide the Independent Monitor’s certification to Hydro USA, and simultaneously provide a copy to the EPA, with the submission of the Independent Monitor’s Annual Report, as discussed below.
Particular Duties. It will be the Independent EPA Compliance Auditor's duty to certify Respondents' compliance with this Agreement to the EPA. The Independent EPA Compliance Auditor will review any reports developed by Respondents, the Independent Consent Decree Auditor, or the Independent Process Safety Consultant pursuant to the Plea Agreement, Consent Decree or this Agreement, and shall certify to the EPA whether or not Respondents have complied with the terms of this Agreement during the reporting period. The Independent EPA Compliance Auditor's certifications must be received by the EPA no later than thirty (30) days after receipt of Respondents' annual reports as discussed in Paragraph 50 below. Should the Independent EPA Compliance Auditor conclude that Respondents are not in compliance with this Agreement, the Independent EPA Compliance Auditor shall prepare a report consisting of an itemized listing of findings with clear and concise corrective action plans that include specific dates for prompt and reasonable response. After review of the Independent EPA Compliance Monitor's certification, the EPA, at its discretion, may provide additional recommendations to Respondents. If recommendations are provided to Respondents by either EPA or the Independent EPA Compliance Auditor, Respondents shall deliver a written response to EPA and the EPA Independent Compliance Auditor within ninety
