Prevention and Mitigation. You are solely responsible for Customer Content. You will implement IT architecture and processes enabling You to prevent and mitigate damages in line with the criticality of the Customer Content for Your business and its data protection requirements, including a business recovery plan. You will: (a) provide for a backup process on a regular (at least daily) basis and backup relevant data before Dell performs any remedial, upgrade or other works on the APEX Service or Your IT systems; (b) monitor the availability and performance of Your IT environment, including the APEX Service; and (c) promptly react to messages and alerts received from Dell or through notification features of the APEX Service and immediately report any issue You identify to Dell. To the extent that Dell has any liability for loss of Customer Content, Dell will only be liable for the cost of commercially reasonable and customary efforts to recover the lost Customer Content from Your last available backup.

Facilities must take more precautions to assure water intake has acceptable water-quality levels for its housed activities. Depending on the sensitivity of the species chosen and the level of pollution, additional filtration, such as carbon filters and high exposure levels of UV, could be necessary. Additional filtration will aid in removing heavy metals and potential viruses, parasites and bacteria (Xxxxxx & Xxxxx, 2005).  Clean-up of floating wastes: Periodical clean-up of floating wastes is also necessary for preservation of water quality and subsequently protection of aquaculture conditions.  Oil spill detection and treatment: Detection of spills is also important for safeguarding of aquaculture products. Since accidental spills are unavoidable, recovery vessels, oil fences, and other oil spill treatment options should be prepared with a view to minimizing contamination. A contingency plan is important to prevent contamination of aquaculture products in case of an accidental spill. Such a plan should be consistent with the IMO Manual on Oil Pollution Section IIContingency Planning (IMO, 2018).  Positioning of aquaculture facilities: Separation of aquaculture from a port area and other potential contamination sources could be an effective means to minimise risks from operational and accidental discharges. This could be implemented by taking into account prevailing wind and current directions as well as construction of physical barriers.  Optimised design to reduce sound impact: A precautionary approach and optimised system engineering is recommended to reduce the sound impact on culture animals to optimise growth performance (Xxxxxxx & Xxxxxx, 2019).  Regulations on ship discharges and provision of reception facilities: Appropriate regulations on ship discharges and provision of reception facilities are required for control of emissions and effluents from ships. Prevention and Mitigation. OEM shall implement IT architecture and processes enabling OEM to prevent and mitigate damages in line with the criticality of the systems and data for OEM’s business and its data protection requirements, including a business recovery plan. In that regard, OEM shall: (i) provide for a backup process on a regular (at least daily) basis and backup relevant data before Supplier performs any remedial, upgrade or other works on OEM’s IT systems; (ii) monitor the availability and performance of its IT during the performance of Services; and (iii) promptly react on messages and alerts received from Supplier or through notification features of the Products and immediately report any identified issue to Supplier. Insofar as Supplier is liable for loss of data, liability is restricted to the typical effort to recover the available and recoverable data which would have accrued if OEM had appropriately backed up (or mirrored) its data.

The Commonwealth shall implement IT architecture and processes enabling the Commonwealth to prevent and mitigate damages in line with the criticality of the systems and data for the Commonwealth’s business and its data protection requirements, including a business recovery plan. In that regard, the Commonwealth shall: (i) provide for a backup process on a regular (at least daily) basis and backup relevant data before the Contractor performs any remedial, upgrade or other works on the Commonwealth’s IT systems; (ii) monitor the availability and performance of its IT during the performance of Services; and (iii) promptly react to messages and alerts received from the Contractor or through notification features of the Products and immediately report any identified issue to the Contractor. To the extent that the Contractor has any liability for data loss, the Contractor shall only be liable for the cost of commercially reasonable and customary efforts to recover the lost data from the Commonwealth’s last available backup.
