However, we will incur no liability if we are unable to complete the electronic transfer affected by you through the External Account Transfer Service because of any one or more of these circumstances: • Your error that impacts the electronic transfer for any reason. • Your failure to comply with this Agreement and all other requirements as set forth by the Credit Union. • Your failure to provide complete and/or correct information. • Issues such as insufficient available funds and the like that prevent and/or delay the Credit Union from processing your electronic transfer. • Circumstances beyond our control (e.g., fire, floor, interference from outside sources, failure of electronic systems, etc.) that prevent the processing of the electronic transfer despite reasonable precautions on our part. You understand and agree that we must rely on the information provided by you, and you authorize us to act on any instruction to submit an electronic transfer request which has been, or appears to have been, sent or authorized by you. We are not obligated to take any further steps to confirm or authenticate such instructions and will act upon such instructions without getting further confirmation. Name and Account Number Inconsistency. Customer shall ensure the accuracy of its Payment Orders and Instructions. If a Payment Order inconsistently describes the beneficiary, beneficiary's bank, or intermediary bank by name and number, payment might be made by the intermediary or beneficiary's bank on the basis of the number even if the number identifies a person or bank other than the named beneficiary or bank. Customer shall be responsible for any loss associated with such inconsistency.
