Maritime and Aviation Project Labor Agreement. Any construction project undertaken by Permittee pursuant to this Permit, for which the Port approves a permit for construction (the "subject permit"), that exceeds $50,000 when considered together with the value of all construction projects on the Assigned Space or on any site leased by Permittee for which the Port had approved a permit within a 12 month period before the date of the subject permit, is subject to coverage under the terms of the Port's Maritime and Aviation Project Labor Agreement ("MAPLA") as it applies to Port tenants. Failure to utilize MAPLA could lead to grievance and arbitration and the potential for damages, attorney's fees and costs should the Building & Construction Trades Council of Alameda County, AFL-CIO ("Unions") prevail in arbitration. Maritime and Aviation Project Labor Agreement. Any construction project undertaken by Permittee pursuant to this Permit, for which the Port approves a permit for construction (the "subject permit") and for which the estimated cost of construction exceeds $150,000 is subject to coverage under the terms of the Port's Maritime and Aviation Project Labor Agreement ("MAPLA") as it is currently in effect (and may be amended) and as it applies to Port tenants. Before undertaking any construction, modifications, alterations, or other improvements or other work that may be under the jurisdiction of a craft union member of the Alameda County Buildings and Construction Trade Council, Permittee is solely responsible for verifying if a MAPLA is currently in effect and will apply to the work. Permittee agrees to fully comply with the requirements of any currently effective MAPLA as fully as if they were set forth herein.
Maritime and Aviation Project Labor Agreement. The Port’s Maritime and Aviation Project Labor Agreement (“MAPLA”) may apply to Permittee’s construction work and Permittee should be knowledgeable of and shall comply with all applicable provisions of the MAPLA. Specifically, any construction work undertaken by Permittee pursuant to this Permit that exceeds an estimated cost of $150,000 for which the Port issues a permit for construction is subject to coverage by the MAPLA. As described further in the MAPLA, “construction work” includes work subject to prevailing wage determinations or work performed within the craft jurisdiction of the unions signatory to the MAPLA at the time the MAPLA was executed on or around February 1, 2016. Permittee’s failure to utilize MAPLA could lead to grievance and arbitration and the potential for damages, attorney’s fees and costs should the Building & Construction Trades Council of Alameda County and/or its affiliated unions (collectively, “Unions”) prevail in arbitration. With respect to any construction work that is subject to coverage under the MAPLA:  Permittee shall assure that each construction project contractor with whom Permittee contracts (“Prime Contractor”), before beginning its respective construction work, signs a Letter of Assent to the MAPLA;  Permittee shall require by contract that each Prime Contractor require that each subcontractor performing said construction work, regardless of tier, signs a Letter of Assent to the MAPLA;  The Unions are third party beneficiaries of Permittee’s obligations under this Attachment “E” and are entitled to proceed with grievances and arbitration against Permittee under the MAPLA for Permittee’s breach of such obligations; and  Permittee may not assert that the Unions do not have standing to proceed with any such grievance or arbitration proceeding described above or to recover from Permittee damages, attorneys’ fees, and costs if Permittee breaches any such obligations. In the event the Port agrees to any revisions to MAPLA or enters into a new MAPLA, Port shall notify Permittee in writing of such revised or new requirements. After such written notice, such revised or new MAPLA requirements shall become part of this Attachment “A” and shall supersede any conflicting requirements of this Attachment “A”, and Permittee shall be obligated to comply with such revised or new MAPLA requirements as fully as if they were set forth herein.

For Lessee’s work covered by MAPLA, Lessee shall assure that each construction project contractor with whom Lessee contracts (i.e., the prime contractor) and each subcontractor, regardless of tier, signs a Letter of Assent to the MAPLA before beginning their respective work. The Building and Construction Trades Council of Alameda County and its signatory unions are third party beneficiaries of Lessee’s obligations under this subsection and are entitled to proceed with grievance and arbitration against Lessee under the MAPLA for Lessee’s breach of such obligations.

  • COUNTY’S QUALITY ASSURANCE PLAN The County or its agent will evaluate the Contractor’s performance under this Contract on not less than an annual basis. Such evaluation will include assessing the Contractor’s compliance with all Contract terms and conditions and performance standards. Contractor deficiencies which the County determines are severe or continuing and that may place performance of the Contract in jeopardy if not corrected will be reported to the Board of Supervisors. The report will include improvement/corrective action measures taken by the County and the Contractor. If improvement does not occur consistent with the corrective action measures, the County may terminate this Contract or impose other penalties as specified in this Contract.

  • Texas Education Code Chapter 22 Contractor Certification for Contractor Employees Introduction Texas Education Code Chapter 22 requires entities that contract with school districts to provide service s to obtain criminal history record information regarding covered employees. Contractors must certify to the district t hat they have complied. Covered employees with disqualifying criminal histories are prohibited from serving at a sch ool district. Definitions: Covered employees: Employees of a contractor or subcontractor who have or will have continuing dutie s related to the service to be performed at the District and have or will have direct contact with students. The District will be the final arbiter of what constitutes direct contact with students. Disqualifying criminal history: Any conviction or other criminal history information designated by the District, or one of the following offenses, if at the time of the o ffense, the victim was under 18 or enrolled in a public school: (a) a felony offense under Title 5, Texas Penal Code; (b) an offense for which a defendant is required to register as a sex offender under Chapter 62, Texas Code of Criminal Procedure; or (c) an equivalent offense under federal law or the laws of another state. I certify that: NONE (Section A) of the employees of Contractor and any subcontractors are covered employees, as defined abo ve. If this box is checked, I further certify that Contractor has taken precautions or imposed conditions to ensure tha t the employees of Contractor and any subcontractor will not become covered employees.
