MAINTAINING A DRUG-FREE WORKPLACE. 32.1 ENGINEER hereby covenants and agrees to make a good faith effort to provide and maintain during the term of this Agreement a drug-free workplace, and that it will give written notice to OWNER within ten (10) days after receiving actual notice that an employee of ENGINEER has been convicted of a criminal drug violation occurring in ENGINEER’S workplace.

MAINTAINING A DRUG-FREE WORKPLACE. The Greenville Board of Education is committed to maintain a drug free workplace and will enforce a policy requiring all employees to refrain from the use, sale, purchase, possession, or being under the influence of illicit drugs or alcohol while performing contractual duties and/or while using school equipment. Employees who fail to comply with this policy will be subject to discipline, up to and including termination from employment, unless the employee uses the Rehabilitation Option described in this policy.
MAINTAINING A DRUG-FREE WORKPLACE. The Sponsor hereby covenants and agrees to make a good faith effort to provide and maintain a drug-free workplace. The Sponsor will give written notice to the State Agency within ten (10) days after receiving actual notice that the Sponsor or an employee of the Sponsor in the State of Indiana has been convicted of a criminal drug violation occurring in the workplace. False certification or violation of this certification may result in sanctions including, but not limited to, suspension of payments, termination of this Agreement and/or debarment of contracting opportunities with the State for up to three (3) years. In addition to the provisions of the above paragraphs, if the total amount set forth in this Agreement is in excess of $25,000.00, the Sponsor hereby further agrees that this Agreement is expressly subject to the terms, conditions, and representations of the following certification: This certification is required by Executive Order No. 90-5, April 12, 1990, issued by the Governor of Indiana. No award of a contract shall be made, and no contract, purchase order or agreement, the total amount of which exceeds $25,000.00, shall be valid, unless and until this certification has been fully executed by the Sponsor and made a part of the contract or agreement as part of the Agreement documents. The Sponsor certifies and agrees that it will provide a drug-free workplace by: Publishing and providing to all of its employees a statement notifying them that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in the Sponsor’s workplace, and specifying the actions that will be taken against employees for violations of such prohibition;
MAINTAINING A DRUG-FREE WORKPLACE. (A) The Utility and its subcontractors, if any, covenant and agree to make a good faith effort to provide and maintain during the term of this agreement a drug-free workplace, and that written notice will be given to the contracting Local Public Agency and the Indiana Department of Administration within ten (10) days after receiving actual notice that an employee of the Utility has been convicted of a criminal drug violation occurring in the Utility's workplace.

MAINTAINING A DRUG-FREE WORKPLACE. Section A Purpose The Shoreline Fire Department (Department) and Shoreline Firefighters, IAFF Local 1760 (Union) recognize that inappropriate drug and/or alcohol use by employees threatens public welfare and the safety of Department personnel. It is the goal of the Department and Union to eliminate or absolve illegal drug use, the abuse of legal drugs and alcohol abuse through education and rehabilitation of the affected employee. The possession, use or being under the influence of alcoholic beverages or unauthorized drugs shall not be permitted in the Department’s stations, work sites or while an employee is on duty or representing the Department in an official capacity. The Department and Union agree to negotiate a Policy that assures compliance with the Federal Drug Free Workplace Act of 1988 (PL. 100-690). The Department and Union agree to a Policy and Procedure that are responsive to the unique working conditions of a fire department and the potentially dangerous and responsible work that is performed by its members.
MAINTAINING A DRUG-FREE WORKPLACE. (a) Seller hereby covenants and agrees to make a good faith effort to provide and maintain a drug-free workplace. Seller will give written notice to Buyer within ten (10) days after receiving actual notice that Seller or an employee of Seller has been convicted of a criminal drug violation occurring in Seller's workplace.
MAINTAINING A DRUG-FREE WORKPLACE. Tenant hereby covenants and agrees to make a good faith effort to provide and maintain during the term of this agreement a drug-free workplace, and that it will given written notice to Indiana Department of Administration within ten (10) days after receiving actual notice that an employee of Tenant has been convicted of a criminal drug violation occurring in Tenant's Leased premises. In addition to the provisions of subparagraph A above, if the total Lease amount set forth in this agreement is in excess of $25,000.00, Tenant hereby further agrees that this agreement is expressly subject to the terms, conditions, and representations contained in the drug‑free workplace certification executed by Tenant in conjunction with this agreement and which is set forth in article XXXVIII (38) of this Lease. It is further expressly agreed that the failure of Tenant to in good faith comply with the terms of subparagraph A above, or falsifying or otherwise violating the terms of the certification referenced in subparagraph B above shall constitute a material breach of this agreement, and shall entitle the Landlord to impose sanctions against the Tenant including, but not limited to, suspension of Lease payments, termination of this agreement and/or debarment of the Tenant from doing further business with the State for up to three (3) years.
