LEAVES OF ABSENCE WITHOUT SALARY. 5-9.01 The Board shall grant a regular employee a leave of absence without salary on a full-time or part-time basis for reasons it deems valid for a maximum duration of twelve (12) consecutive months, which leave of absence may be renewed. In the case of a part-time leave, the relevant provisions of the Agreement shall apply to the employee concerned.

Types of leave of absence without salary • Leave of absence to enable a regular employee to accompany his or her spouse whose place of work changes temporarily or permanently (5– 9.02); • leave to extend the leave provided for in Appendix XIV (leave for the spring and fall goose hunting season), in conformity with the school calendar in force in the community; • Leave of absence for studies in a program leading to a diploma in an officially recognized institution (5–9.04); • Leave of absence without salary of a minimum duration of one month without exceeding twelve consecutive months. The regular employee may benefit from such a leave every time he or she has accumulated at least five years of seniority (5–9.05); • Leave of absence without salary for an employee suffering from a prolonged illness (5–9.06). Xxxxxxx of the leave of absence without salary • Leave of absence without salary may be renewed at the employee’s request; • The request must be made in writing, at least 30 days before the beginning of the leave, and must specify the reasons for the request (5– 9.07). Return to the service of the school board • In the first six (6) months of leave, the employee may, before or during the leave without pay, terminate the leave for good reason, by submitting a written request to that effect at least thirty days in advance (5-9.10) • On his or her return, the employee will be reinstated in the position he or she held upon his or her departure (5–9.11). Use of the leave of absence without salary • The employee who uses his or her leave for purposes other than those for which he or she obtained it will be considered as having resigned as of the beginning of the leave of absence (5–9.13). Temporary employees Article 5–9.00 does not apply.

Moreover, an employee may participate in the other group insurance plans and the supplemental pension plan, provided he or she pay the total amount of premiums and contributions due. Upon his or her return, the employee shall resume his or her position unless it was abolishedduring his or her absence or the employee concerned was displaced pursuant to article In the case of resignation, during or at the end of this leave of absence, the employee shall reimburse the board any amount paid for and in the name of the said employee. The employee who uses his or her leave of absence for purposes other than those for which he or she obtained it shall be considered as having resigned as of the beginning of his or her absence. The leave of absence without salary provided for in clause may be a part-time leave, under the same conditions. In this case, the employee concerned shall retain his or her regular or tenured employee status, where applicable, but for the other working conditions he or she shall be considered as a part-time employee.

  • Other Leaves of Absence In the event that you are on a bona fide leave of absence, not otherwise described in this definition, from which you have not returned to employment with the Company or an Affiliate, your Separation from Service has occurred on the first day on which your leave of absence period exceeds six months or, if earlier, upon your termination of employment (provided that such termination of employment constitutes a Separation from Service in accordance with the last sentence of the first paragraph of this definition).

  • Leaves of Absence Article 11 applies for both paid and unpaid leaves. For the purposes of an unpaid 11.25 hour shift, the deduction from pay shall equate to 14.05 hours. For the purposes of an unpaid 7.5 hour shift, the deduction from pay shall equate to 9.375 hours.

  • Sick Leave Without Pay Sick leave without pay shall be granted to an employee who does not qualify for sick leave with pay, or who is unable to return to work at the termination of the period for which sick leave with pay is granted.

  • Paid Leaves of Absence Paid leaves of absences granted under this Article shall not exceed the employee's normal work schedule.

  • Maternity Leave Without Pay (a) An employee who becomes pregnant shall, upon request, be granted maternity leave without pay for a period beginning before, on or after the termination date of pregnancy and ending not later than eighteen (18) weeks after the termination date of pregnancy.

  • Absence Without Leave Any absence of an employee from scheduled duty that has not been previously authorized by the EMPLOYER may be deemed an absence without leave. Any employee absent without leave will be subject to disciplinary action, and any employee absent without leave for three (3) consecutive days may be deemed to have resigned his/her employment, provided that the EMPLOYER may grant approval for leave subsequent to the unauthorized absence if the employee can conclusively establish to the EMPLOYER that the circumstances surrounding the absence and failure to request leave were beyond the employee's control.
