HAZARDOUS AND TOXIC SUBSTANCES. It is the Contractor's responsibility to ensure the safe handling, application, removal and environmentally sound disposal of all hazardous or potentially hazardous fertilizers, weed killers, and pest control products utilized in this requirement.

HAZARDOUS AND TOXIC SUBSTANCES. The Exhibitor agrees, at all material times Exhibitor is on the Fairgrounds, not to have in its possession, collect, distribute, dispose, release or otherwise discharge any toxic or hazardous waste as defined by Florida and Federal law. In the event the Exhibitor shall be in possession of such hazardous or toxic waste, the Exhibitor shall immediately notify the Fair and Palm Beach County Department of Environmental Resource Management and such other governmental agency or body as may be required by law and the Fair relative to such materials. Additionally, Exhibitor agrees not to throw away any refuse or empty any fluids on the ground. Grease barrels are provided by the Fair in convenient locations and must be used. In the event an Exhibitor shall dump grease at locations not authorized by the Fair, they shall be subject to a fine of $1,000.00 for each infraction by the Fair, plus any fine imposed by any governmental entity, and shall be deemed in material breach of this Agreement and subject to immediate removal from the Fairgrounds.
HAZARDOUS AND TOXIC SUBSTANCES. Bidder must comply with all applicable Federal, State, County and City laws, ordinances and regulations relating to hazardous and toxic substances, including such laws, ordinances and regulations pertaining to information hazardous and toxic substances, and as amended from time to time. Bidder shall provide the City of Fairhope with a “Material Safety Data Sheet” for all goods that carry one.
HAZARDOUS AND TOXIC SUBSTANCES. Seller must comply with all applicable Federal, State, and County laws, ordinances and regulations relating to hazardous and toxic substances, including such laws, ordinances and regulations pertaining to access to information about hazardous and toxic substances, and as amended from time to time. Seller shall provide the College with a “Safety Data Sheet” including reference to the Purchase Order number, or in the case of a controlled hazardous waste substance, a hazardous waste manifest for all hazardous chemicals listed or subsequently added to the Chemical Information List in compliance with applicable laws, ordinances and regulations.
HAZARDOUS AND TOXIC SUBSTANCES. In addition to, and not by way of limitation of the provisions of Section 26 above, TENANT hereby covenants with LANDLORD and represents and warrants to LANDLORD as follows:
HAZARDOUS AND TOXIC SUBSTANCES. Manufacturers and distributors are required by the federal "Hazard Communication Standard" (29 CFR 1910:1200), and the Maryland "Access to Information About hazardous and Toxic Substances" law to label each hazardous material or chemical container, and to provide Material Safety Data Sheets to the purchaser. The Contractor must comply with these laws, to the extent applicable, and must provide the County with copies of all applicable and relevant documents, including Material Safety Data Sheets prior to performance of services or contemporaneous with delivery of goods.
HAZARDOUS AND TOXIC SUBSTANCES. Tenants shall not use, generate, store, or dispose, or give consent to anyone else to use, generate, store or dispose, any hazardous, toxic, or radioactive materials [hereinafter referred to collectively as "Hazardous Materials"]. As herein used, Hazardous Materials shall include, without limitation, those materials identified in Sections 66680 through 66685 of Title 22 of the California Administrative Code Division 4, Chapter 30, as amended from tome to time, and those substances defined as "hazardous substances," "hazardous materials," "hazardous waste", or other similar designations in the Comprehensive Environmental Response, Compensation and Liability Act of 1980, as amended, 42 USC, Section 9601 ET SEQ., the Hazardous Materials Transportation Act, 49 USC, Section 1801 ET SEQ., and any other governmental statutes, laws, ordinances, rules, and regulations now or hereafter in effect. Tenant shall indemnify, defend and hold Landlord from and against any and all claims, damages, costs, and liabilities, including all foreseeable and unforeseeable consequential damages, directly or indirectly arising out of the use, generation, storage, or disposal of Hazardous Materials by Tenant or any person claiming under Tenant, including, without limitation, the cost of any required or necessary repair, clean up, or detoxification and the preparation of any closure or other required plans, whether such action is required or necessary prior to or following the termination of this Lease, to the full extent that such action is attributable, directly or indirectly, to the use, generation, storage, or disposal of Hazardous Materials by Tenant or any person claiming under Tenant. Neither the written consent by Landlord to the use, generation, storage or disposal of Hazardous Materials nor the strict compliance by Tenant with all statutes, laws, ordinances, rules and regulations pertaining to Hazardous Materials shall excuse Tenant form Tenant's obligation pursuant to the foregoing indemnity shall survive the termination of this Lease.

HAZARDOUS AND TOXIC SUBSTANCES. Lessee agrees that so long as this Lease shall remain in effect, the Leased Premises shall NOT be used in or for the generation, manufacture, treatment, disposal, release or threatened release of any hazardous or toxic substances, as those terms are defined in the comprehensive Environmental Response, Compensation and Liability Act of 1980, as amended, 42 U.S.C. Section 9601, et seq. (1980), and as those terms are defined in any applicable state or local laws, or regulations including AS 46.08. To the extent allowed by law, Lessee agrees to fully defend, indemnify, and hold harmless Owner against any and all claims and losses resulting from a breach of this provision of this Lease. This obligation to indemnify shall survive the payment of all rents and the termination of this Lease. Lessee may store and use hazardous or toxic substances in reasonable quantities solely for its own operations as long as such storage and use is done in a safe manner in accordance with all local, state and federal regulations.

Pursuant to Occupational Safety and Health Act (OSHA) 29 CFR 1910, where applicable, SDS for the products supplied or used as a result of this contract must be sent to the attention of Coordinator for Campus Operations, Harford Community College, 000 Xxxxxx Xxx Rd., Bel Air, MD 21015-1627. SDS must identify the contract number under which the products were supplied or used. The successful contractor shall submit Safety Data Sheets on any item requested by the procurement manager or other College official.
