Excluded Support. Examples of services not covered by this Agreement (but which may be available for additional fees as described in Exhibit B payable within thirty (30) days after billed) include: • Administrator or end user training • Client requested enhancements and features • Software installation or onsite support • Environment configuration • Translations from English to other languages • Environment trouble shooting issues not associated with Relativity’s Software • Trouble shooting problems with data not formatted per Relativity’s standard load file specifications • Database/case migration to or from the Software
Excluded Support. 6.1 Beezy’s obligations related to the Support Services shall cease in case the Beezy Software Problem or non-operation of the Beezy Software has been caused by any factor outside the control of Beezy, including but not limited to:
Excluded Support. Support to be provided under this Agreement does not include repair of damage, replacement of parts or increase of service time attributable to reasons other than normal wear and tear, including but not limited to the combination or operation or use of Equipment, Software or Workstations with materials not supplied by Davox or for purposes for which the Equipment, Software or Workstation was not designed, unusual physical or electrical stress, accident, neglect, acts of God, or misuse, abuse, or modification of the Equipment, Software or Workstations by persons other than Davox. When support service is required for reasons other than normal wear and tear, services will be performed at Davox's then prevailing time and materials rate and an invoice issued to the Customer. If Customer modifies the Equipment, Software or Workstation or adds foreign devices to the UNISON System or Workstation, then Davox may at its option, (i) terminate this Agreement or (ii) support and service such modifications and foreign devices at its then prevailing rates. Provisions or replacement of operational supplies or media items are specifically excluded form support services hereunder.

  • Product Support a. In the event that any goods delivered under this contract become defective or malfunction for any reason and at any time (even after the applicable warranty period has expired), including while “in-orbit” if integrated into a satellite, Seller shall promptly perform a failure verification or analysis and determine the appropriate corrective action at no additional cost to Buyer. Seller shall take the appropriate measures to correct all defects, determined to be Seller's responsibility, in all applicable documentation, undelivered goods, and delivered un-launched goods, as required by Buyer.

  • Technical Support State Street will provide technical support to assist the Fund in using the System and the Data Access Services. The total amount of technical support provided by State Street shall not exceed 10 resource days per year. State Street shall provide such additional technical support as is expressly set forth in the fee schedule in effect from time to time between the parties (the “Fee Schedule”). Technical support, including during installation and testing, is subject to the fees and other terms set forth in the Fee Schedule.

  • Customer Support If Customer is entitled to receive Customer Support as part of a separately purchased Service Plan, Sage warrants that while Customer’s Service Plan is in effect and if it has paid all required Service Plan fees, Sage will use qualified personnel to provide Customer Support in a professional manner consistent with industry standards. Customer’s sole remedy under this section 5.2 is limited to Sage’s re-performance of the Customer Support services giving rise to Customer’s claim.

  • Software Support During the Term, Seller shall use commercially reasonable efforts to provide all Software updates and qualified Software upgrades in accordance with the terms of the Service Contract as such materials become commercially available for distribution. Purchaser’s use of all Software, updates, and upgrades of Software shall be subject to this Agreement, the Original Terms, and the applicable XXXX.

  • Administrative Support Employee shall be provided with office space and administrative support.
