Hardware damage. Except if in accordance with our instructions, including as set forth in the User Guide or as stated in an applicable Order Form, we will not be obligated, and you waive any right to make any such claim, to repair or replace missing or inoperative Hardware that is a result of any of the following by you, your Users, or any other person or entity under your direction or control: (a) interference, tampering, or modification to the Hardware in any way; and/or (b) placing, movement, removal, replacement, or modification of the location of the Hardware; and/or (c) reverse engineering, opening, or unpackaging the Hardware; and/or (d) any other damage that is not Non-Customer Damage. You waive any claim to any loss or deficiency of Service hereunder arising due to any of the foregoing.

Hardware damage. A fee of £275 will be chargeable if GBG is called out to the Location for Local Intervention where the damage to the Hardware has been caused by the Client.   • Extensive Damage In the event damages as referenced in Section .01 of this Article are so extensive as to render all or a significant portion of the Premises untenable, but capable of being repaired within 120 days, Company will give Authority immediate notice thereof, and Authority will make the repairs with due diligence, at its own cost and expense.

  • Private Vehicle Damage Where an employee’s vehicle is damaged by a student at a worksite or an approved school function, or as a direct result of the employee being employed by the employer, the employer shall reimburse the employee the lesser of actual vehicle damage repair costs, or the cost of any deductible portion of insurance coverage on that vehicle up to a maximum of $600.

  • Malicious Software 12.1 The Supplier shall, as an enduring obligation throughout the Term, use the latest versions of anti-virus definitions available [from an industry accepted anti-virus software vendor] to check for and delete Malicious Software from the ICT Environment.

  • E10 Malicious Software E10.1 The Contractor shall, as an enduring obligation throughout the Contract Period, use the latest versions of anti-virus definitions available from an industry accepted anti-virus software vendor to check for and delete Malicious Software from the ICT Environment.

  • RISK OF LOSS OR DAMAGE From the point the equipment leaves Company’s office in El Cajon, CA the Customer assumes all risks of loss or damage to the equipment from any cause.

  • Software Warranty We warrant that the Tyler Software will perform without Defects during the term of this Agreement. If the Tyler Software does not perform as warranted, we will use all reasonable efforts, consistent with industry standards, to cure the Defect in accordance with the maintenance and support process set forth in Section C(9), below, the SLA and our then current Support Call Process.

  • LOST, STOLEN OR DAMAGED CARDS If the Cardmember loses the Card or if the Card is damaged or stolen or if the PIN became available to any other persons, the Cardmember must immediately inform AEME by telephone. In addition, the Cardmember shall provide AEME with a written notification within 3 days from the date of the occurrence of any of the above listed events, as per applicable laws. To inform AEME by phone, call the number indicated in the Cardmember Additional Information Leaflet. Failure to comply with the provisions of this article will render the Cardmember liable for all Transactions made on his or her lost or stolen Card until the time the Card is reported as lost or stolen to AEME. However, the Cardmember shall at all times be fully liable for all Charges including Cash Withdrawals even if these Charges were made by third parties if these third parties gained possession of the Card or any Supplementary Card or the PIN with the knowledge, permission, approval or other acts of the Cardmember or any Supplementary Cardmember or because of their negligence. If the Card is found after it was reported lost or stolen, the Cardmember may not use or attempt to use the Card at issue and shall immediately inform AEME which will take the appropriate action.
