Design and Installation. (a) The design for the Solar Facility will be presented to you prior to installation. You will have five (5) business days following this presentation to request a change or cancel this Lease pursuant to Section 12(e). Otherwise, you will be deemed to have approved the Solar Facility design. With your written, deemed, or verbal approval, Solar Facility installation may begin at any time.
Design and Installation at Site 1 - Oakland The goal of this task is to complete all necessary tasks to make ready the Site 1 charging station for use. Those tasks include completing pre-project designs and installing the charging equipment at the charging site. The Recipient shall: • Review and update all pre-kickoff designs to final versions, if needed. • Ship site specific equipment to the site location. • Install equipment at the site location. • Inspect and test charging equipment with a truck charging event – plug in, charge, unplug. • Document commissioning of equipment and provide a Commissioning Report that summarizes equipment commissioning and provide a copy to the CAM. • Take High-quality Photos of Charging Equipment and provide to the CAM. • Submit to the CAM an AB 841 Certification that certifies the project has complied with all AB 841 (2020) requirements specified in Exhibit C or describes why the AB 841 requirements do not apply to the project. The certification shall be signed by Recipient’s authorized representative. • Submit to the CAM the Electric Vehicle Infrastructure Training Program (EVITP) Certification Numbers of each EVITP Certified Electrician that installed electric vehicle charging infrastructure or equipment. EVITP Certification Numbers are not required to be submitted if AB 841 requirements do not apply to the project. Design and Installation. All decisions to be made in connection with the manner of design and installation of the Water Main Extension, the type of materials to be used, and the maintenance thereof shall be and shall so remain at the exclusive discretion and under the sole control of the District.

Design and Installation. Developer shall design the PV System in accordance with Good Engineering Practice, shall consult with and receive input from Host with respect to integration of the PV System with the Host’s facilities and submit the final design for Host’s and CVEC’s approval, not to be unreasonably withheld or delayed. Subject to delays excused hereunder, or the failure of the Host to comply with its obligations hereunder or CVEC to comply with its obligations under the PPA, Developer shall commence construction of the PV System no later than the Outside Construction Commencement Date and will proceed diligently and continuously thereafter until completion, but in no event shall the installation be completed later than the Outside Commercial Operation Date. Developer shall install the PV System in accordance with Good Engineering Practice, all Applicable Legal Requirements, applicable contractor, subcontractor and vendor warranties or guarantees, manufacturer’s warranties, instruction and specifications, as further identified in the Common Technical Specifications set forth in Exhibit E, applicable requirements of the insurance policies maintained by Host with respect to the PV System, and the terms of this Agreement.
