Delivery and Installation. Delivery and Installation of the Product will take place at a mutually agreed time between Xxxxxx Xxx Ltd and the Restaurant and will only be carried out after payment in full of the refundable deposit has been made by the Restaurant.

Contractor shall utilize UConn Health’s inbound shipping accounts upon UConn Health’s request. The burden of proof of proper delivery shall rest with Contractor. Time is of the essence in Contractor’s performance of this Contract. In order for the time of delivery to be changed, Contractor must submit a request in writing to an authorized representative of UConn Health’s Procurement Department. Goods shall be securely and properly packed for shipment, according to accepted standard commercial practice, without extra charge for packing cases, baling or sacks. The containers shall remain the property of UConn Health unless otherwise stated in this Contract. At the sole option of UConn Health, Goods may be subject to re-weighing on State sealed scales. Installation shall be performed by Contractor in accordance with industry standards.
Delivery and Installation. Lessee shall be responsible for payment of all transportation, packing, installation, testing and other charges associated with the delivery, installation or use of any Equipment which are not included in the Agreement with respect to such Equipment.
Delivery and Installation. Within five (5) business days of the Effective Date of this Agreement, OANDA shall electronically deliver the Licensed Materials to Licensee. All Licensed Materials will be sent to Licensee’s designated email address as specified in Section 18.12 (Notices). Licensee agrees to be responsible for installation of the Licensed Materials.
Delivery and Installation. Lessee shall arrange with IBM for the delivery of the Equipment and Programming and for installation of the Equipment at the Equipment Location. Lessee shall pay any delivery and installation charges. Lessor shall not be liable to Lessee for any delay in, or failure of, delivery of the Equipment and Programming. Lessee shall examine the Equipment and Programming immediately upon delivery. If the Equipment is not in good condition or the Equipment or Programming does not correspond to IBM's specifications, Lessee shall promptly give IBM written notice and shall provide IBM reasonable assistance to cure the defect or discrepancy.

PSINet shall, at its own expense, deliver, install and maintain its collocated Equipment in a safe condition and meeting or exceeding the standards set forth in Section 7.2. At no additional charge, IXC shall provide to PSINet Spaces that are reasonably proximate to each other in light of the type of Equipment that PSINet is installing; provided, however, that if PSINet or its Equipment requires a specific geometric arrangement, and IXC determines that in order to accommodate PSINet or its Equipment, rearrangement of the existing facilities at the IXC Premises is required, PSINet agrees to reimburse IXC for any such make-ready costs. IXC will advise PSINet in writing of any estimated make-ready charges (including investigation, design and engineering fees) for such rearrangement work and PSINet shall make payment to IXC within thirty (30) days from its receipt of IXC's invoice therefor.
