Contractor's Design. The Contractor must: design the parts of the Works which the Contract requires it to design in accordance with the Works Description, the Preliminary Design Solution and the other requirements of the Contract and for this purpose (but without limitation) prepare all relevant Design Documentation; and submit the Design Documentation it prepares to the Contract Administrator in accordance with the documentation program approved by the Contract Administrator under clause 6.1.
Contractor's Design. Task Order response deliverables
1) The Contractor shall perform all activities and provide all resources necessary to develop and manage the design and shall support the development of a construction methodology in accordance with the Task Order.
2) In response to a proposed Task Order, the Contractor provides a Technical Design Overview including a detailed review of all technical documentation related to the Technical Requirements Specification and provides confirmation that they can comply with all aspects of Scope with any exceptions noted.
3) The Contractor, within their Technical Design Overview, clearly identifies to the Employer key risks which they have identified, and outlines their proposals to mitigate these or any aspect of the works for which determination of requirements/risks is reliant upon engagement with others.
4) The Contractor provides a draft design programme.
5) The Contractor shall ensure that the multi-disciplinary technical delivery of the contract is led by an experienced design manager to ensure the delivery of a high quality, fully co-ordinated and integrated design solution.
6) Where specialist activities are required the Contractor shall demonstrate to the satisfaction of the Employer that personnel engaged to undertake the work are fully qualified and certified to carry out the task. Where this cannot be demonstrated the Employer has the right to direct removal of these persons.
7) Where the Employer directs the removal of persons the Contractor shall replace them with persons of proven competency in a timely manner ensuring that project/contract delivery milestones are not compromised.
8) The Contractor provides a resource schedule in support of their Task Order estimate showing for each activity on the draft design programme: ▪ The employed individuals’ grades and contract rates; and ▪ The individuals’ allocated durations.
9) The draft design programme and accompanying resource schedule shows separately the resources required for each of the following stages: ▪ Concept design; ▪ Detailed design; ▪ Specialist design; ▪ Delivery design support; and ▪ Close-out activities.
10) Where not previously submitted, the Contractor provides the CV’s of all staff used to Provide the Services, along with confirmation of their competency status and how any competency shortfalls are managed.
Contractor's Design. “The Contractor shall remain responsible for his tendered design and the design under this Clause, both of which shall be fit for the intended purposes defined in the Contract and he shall also remain responsible for any infringement of any patent or copyright in respect of the same”
Contractor's Design. Where contractor is to supply the design of designated parts of the permanent Works or temporary Works he shall supply full working drawings supported by a professional engineer’s design certificate.

The certificate is signed by the Contractor’s insurer or insurance broker. The Project Manager or the Client accepts the certificate if the insurance complies with this clause and if the insurer’s commercial position is strong enough to carry the insured liability. The Client’s acceptance of an insurance certificate provided by the Contractor does not change the responsibility of the Contractor to provide the insurance stated in this clause.’ X18.5 delete final bullet Delete components 11 to 14 and replace with the following: For the people who are directly employed by the Contractor: The cost calculated by multiplying the relevant rate from the current rate card (People Rates within the Scape Framework Commercial Model for Construction Hours), by the time spent working on the Project. Time recorded is that shown on the Contractors time recording system. People rates are the rates for the applicable role and seniority listed. For people who are not directly employed by the Contractor but are paid by the Contractor according to the time they work, the amounts paid by the Contractor.

The Contractor must: design the parts of the Works which the Contract requires it to design in accordance with the Works Description, the Preliminary Design Solution and the other requirements of the Contract and for this purpose (but without limitation) prepare all relevant Design Documentation; as part of the program it is to prepare under clause 10.2, submit to the Contract Administrator for approval a documentation program which makes allowance for the Design Documentation to be submitted to the Contract Administrator in a manner and at a rate which will give the Contract Administrator a reasonable opportunity to review the Design Documentation within the period of time within which the Contract Administrator may review the Design Documentation under clause 6.3; and submit the Design Documentation it prepares to the Contract Administrator in accordance with the documentation program approved by the Contract Administrator under paragraph (b).

The Contractor must: prepare Remediation Design Documentation in accordance with the Technical Specification and the other requirements of the Contract, if: the Contract Particulars state that the Contractor must prepare Remediation Design Documentation; or directed to do so under clause 11.4 or 11.8(b); and where paragraph (a)(i) applies: as part of the program it is to prepare under clause 10.2, submit to the Contract Administrator for approval a documentation program which makes allowance for the Remediation Design Documentation to be submitted to the Contract Administrator in a manner and at a rate which will give the Contract Administrator a reasonable opportunity to review the Remediation Design Documentation within the period of time within which the Contract Administrator may review the Remediation Design Documentation under clause 7.3; and submit the Remediation Design Documentation it prepares to the Contract Administrator in accordance with the documentation program approved by the Contract Administrator under paragraph (b). The Contract Administrator may: review any Remediation Design Documentation, or any resubmitted Remediation Design Documentation, prepared and submitted by the Contractor; and within 10 business days of the submission by the Contractor of such Remediation Design Documentation or resubmitted Remediation Design Documentation, reject the Remediation Design Documentation if in the Contract Administrator's reasonable opinion the Remediation Design Documentation does not comply with the requirements of the Contract. If any Remediation Design Documentation is rejected, the Contractor must submit amended Remediation Design Documentation to the Contract Administrator. The Contractor must not commence execution of any part of the Remediation Works to which any Remediation Design Documentation which it has submitted to the Contract Administrator applies, unless the Contract Administrator has had the number of days specified in paragraph 7.3(a) to review the Remediation Design Documentation and has not rejected the Remediation Design Documentation.
