DB Contractor shall construct the Project in accordance with the Final Design Documents and the Construction Documents.
The Final Design Documents may be changed only with prior written approval of TxDOT.
Design Documents shall become TxDOT’s property upon preparation; Construction Documents shall become TxDOT’s property upon delivery to TxDOT; and other documents prepared or obtained by DB Contractor in connection with the performance of its obligations under the DBC Documents, including studies, manuals, Record Drawings, technical and other reports and the like, shall become the property of TxDOT upon DB Contractor’s preparation or receipt thereof.
TxDOT warrants that the design of the Project as reflected in the Final Design Documents, is adequate for the construction of the Project.
DB Contractor shall cause the engineer of record for the Project to sign and seal all Final Design Documents.
