Construction Documents Services. 2.3.3.1 Based on the Design Development Documents approved by Webvan for each DC Project and the approved Project Budget for each such DC Project, Bechtel shall prepare the final drawings, plans and specifications setting forth in detail the requirements for Development of each such DC Project, collectively referred to herein as the "CONSTRUCTION DOCUMENTS". The Construction Documents shall include the detailed Performance Standards for the operation of the materials handling and distribution system and equipment included within such DC Project.

The Architect/Engineer will be responsible for managing the design to stay within such Guaranteed Maximum Price proposal or Amount Available for the Construction Contract. The Architect/Engineer shall review the Construction Documents as they are being prepared at intervals appropriate to the progress of the Project with the Owner and Construction Manager at the Project site or other location specified by Owner in the State of Texas. The Architect/Engineer shall utilize the model(s) to support the review process during Construction Documents. The Architect/Engineer shall provide the Construction Manager with a compact disc containing documents and data files derived from the model to assist the Construction Manager in fulfilling its responsibilities to the Owner.

  • Complete Agreement; Construction This Agreement, including the Schedules hereto, shall constitute the entire agreement between the Parties with respect to the subject matter hereof and shall supersede all previous negotiations, commitments and writings with respect to such subject matter. In the event of any inconsistency between this Agreement and any Schedule, the Schedule shall prevail. The rights and remedies of the Parties herein provided shall be cumulative and in addition to any other or further remedies provided by law or equity.
