Available But Unearned Vacation Sample Clauses

Available But Unearned Vacation. The Village will continue its policy of making available to employees the use of vacation time on January 1 of each year in which vacation will be earned. By way of example, an employee hired on October 1 will accrue earned vacation on each subsequent October 1 anniversary of date of hire. However, beginning January 1 of each year and prior to October 1, this employee may request use of the vacation in advance of it being earned in October. If this employee leaves the employment of the Village prior to October 1, and has used the paid vacation which was to accrue on October 1, then the employee must reimburse the Village for vacation pay received for the used but unaccrued amount of vacation. The Village recognizes that upon separation from service, the Village, by State Law, must prorate and pay vacation days based upon the number of months the separating employee worked from his last anniversary date to the date of separation. This proration shall be credited against any claim by the Village for a refund of used but unearned vacation time.
