Application for Interim Payment Certificates. The Contractor shall submit a Statement in six copies to the Engineer after the end of the period of payment stated in the Contract (if not stated, after the end of each month), in a form approved by the Engineer, showing in detail the amounts to which the Contractor considers himself to be entitled, together with supporting documents which shall include the relevant report on progress, and in respect of payments 2, 3 and 4 (as those payments are described in the payment schedule set out in Attachment C to the Particular Conditions), the relevant certificate issued by the Engineer issued in accordance with sub-clause 4.21 [Progress Reports], as well as the statements issued by each Subcontractor performing construction works and confirming that no amounts are overdue from the Contractor as of the date of the issue of the statement. The Statement shall include the following items, as applicable, which shall be expressed in Euro: the estimated contract value of the Works executed for payment on a re-measurement basis pursuant to Sub-Clause 12.3 [Contract Price and Evaluation] or, where applicable, on a Lump Sum basis pursuant to Sub-Clause 12.4 [Lump Sums] and the Contractor’s Documents produced up to the end of the month (including Variations but excluding items described in sub-paragraphs (b) to (g) below); any amounts to be added and deducted for changes in legislation and changes in cost, in accordance with Sub-Clause 13.7 [Adjustments for Changes in Legislation] and Sub-Clause 13.8 [Adjustments for Changes in Cost]; any other additions or deductions which may have become due under the Contract or otherwise, including those under Clauses 8.5A and 20 [Claims, Disputes and Arbitration]; the deduction of amounts certified in all previous Payment Certificates; any amounts to be added for the Contractor’s Establishment Payment in accordance with Sub-Clause 2.1; the amounts to be added for the Design Management Fee ; any Reimbursable Sums.
Application for Interim Payment Certificates and after the Employer receives (i) the Performance Security in accordance with Sub-Clause 4.2 [Performance Security] and (ii) a guarantee in amounts and currencies equal to the advance payment. This guarantee shall be issued by an entity and from within a country (or other jurisdiction) approved by the Employer, and shall be in the form annexed to the Particular Conditions or in another form approved by the Employer. The Contractor shall ensure that the guarantee is valid and enforceable until the advance payment has been repaid, but its amount may be progressively reduced by the amount repaid by the Contractor as indicated in the Payment Certificates. If the terms of the guarantee specify its expiry date, and the advance payment has not been repaid by the date 28 days prior to the expiry date, the Contractor shall extend the validity of the guarantee until the advance payment has been repaid. Add the following sub-clauses at the end of Clause 14.3 of Part 3 General Conditions; 14.3.1Tax Deduction at Source Deduction towards Income Tax, and any other tax, may be made at source from each payment made by the Engineer, as may be directed by Income Tax Department and other statutory bodies or as provided in statute, relevant acts, rules, circulars and directions issued there under. 14.3.2Post Payment Audit The Employer reserves the right to carry out a post payment audit and/or technical examination of the Works, and the Final account, including all supporting vouchers, abstracts, etc., and to make a claim on the Contractor for the refund of any excess amount paid to him, if as a result of such examination, any over- payment to him is discovered to have been made in respect of any work done or alleged to have been done by the Contractor, under the Contract. If any under-payment is discovered, the same shall be paid by the Employer to the Contractor. Such payments or recoveries, however, shall not be subject to any interest.
